So almost a year ago i was raped at a party while passed out after a night of drinking...7 months later i finally got the DNA results and it was positive
I got a call from the attorney office saying that they just got the complaint and he is formally charged on a summon.
What does that mean? formally charged? Does that mean he is going to get charged with it for sure and what exactly is he going to court for..to try to get out of it or his punishment??

It means that they have filed formal charges, an arrest warrant will be issued, and the person will face arraignment, possibly post bond (unless the judge denies bond) and get out of jail pending trial, and go to trial. |

it means that they have officaly been sent a summons to appear in court and now that its sent if he doesnt show up he will be arrested.
He will be tried for rape and hopefully convicted. If hes convicted then he will go to jail for as long as the judge thinks nessasary. |

Formally charged means that he is going to have to go to court to answer to criminal charges - he will have to go to trial. It means that the police (or the city, really) is taking him to court to have a judge or jury hear the case and decide if he committed the crime they believe he committed. It is a way for the Police/City to say that they believe he did what you say he did and take it to court. It is up to the judge or jury to decide if he is guilty and should be punished. |

I am sorry to hear about the rape issue. What is sounds like to me is that now that the DNA results are in, and they are positive, there is enough evidence to prove that the rapist did rape you. More than likely, he will be going to court so that the judge can give him his punishment sentence-hopefully prison time. Since the DNA results are positive, I don't see how he can get out of it. Good luck to you with this case. |
