Can bouncers hit you?

i was in a night club and made an error by mistaking the ladies toilets as the exit! rightfully the bouncer stopped me going in, however he physically grabbed me, to which i was wasn't happy and shouted what are you doing? ok fair enough he could of held me and thrown me out of the club, however he head butted me, threw me on the floor and repeatedly hit me in the head, he then strangled me to the point that i passed out momentarily, then I was ejected….. I did not at any point physically threaten him or swing any punches. I am worried as I reported this to the police, they looked at the CCTV and have decided not to pursue. I know that that footage will prove I was assaulted and the police will not let me see it. I believe that the police just can’t be bothered to deal with the case. I have scaring to my face and a swollen cheek inc scaring to my neck where the bouncer strangled me. ……what can I do?

If you are not going to pursue it then don't go back there. By not pursuing you just gave them permission to continue this behavior which the police obviously condone also.
You could file a civil suit if you can obtain the tape and have witnesses.

Round up witnesses and get a lawyer ,and a warrant for that tape!!

I would think that by now the video tape has been overprinted and there will be no evidence. Was there an independant witness? The bouncer commited assault occasioning actual bodily harm. If you don't have a witness and the tape is no longer available I think you will have to put it down to experience. Perhaps you would be better withdrawing your patronage from that night club.

Generally they cannot intentionally hit you except in self defense. (Grabbing or hitting you in order to break up a fight, remove you, etc. may fall under a different category.) Staying out of certain situations is always the best bet to avoid things like this because not all bouncers are good at what they do within the law.

at this point... the police wont pursue... your option if you choose to proceed... is to hire an attorney (i advise not to waste your money)... and get a court order to subpoena the cctv tapes... which have probably been taped over & or destroyed...

i used to be a bouncer myself you were clearly in the wrong... you didnt deserve what you got... according to your statement... BUT if you were drinking SOOOO much you mistook the ladies room for the exit... you probably dont remember ALL the details... your shouting at him is considered an act of aggression... youre probably not gonna win this one... club owners/ the security staff are well versed at what they can "legally" get away with... and i know the club owners are looking out for themselves 1st & foremost the staff 2nd... and problem patrons... last...

if it happened in the UK a bouncer by law can not put a hand on you as this is regarded as assault the can ask you to leave if the person refuses they must call the police if you attacked them they can say self defence

Take pics of your bruising and scaring. See if a lawyer! No matter what someones job they can not beat people. So many bouncers have this I can do anything complex. I'm 4'10'' 115 lbs. female and I have been pushed and shoved around by bouncers simply trying to get people in and out of doors fast enough. I one time fell on my face after getting pushed through a door by a bouncer and instead of picking me up they yelled at me to move!

The CCTV tells the story accurately - unless there is no sound. You describe an over zealous bouncer - the video must show something else - get a lawyer and subpoena the video.

take pictures and file a police report. The bouncer had no right to hit you if you posed no threat to him. If you could prove that you did not do anything threatening to him then your all good. But its your word against his unless you could also find a witness.

If you really wanna press charges and maybe sue the guy get a lawyer, that way the video (if there was indeed one) will have to been shown.

I say get a lawyer take pics of the bruises and sue...try and another excuse like maybe you thought it was the guys bathroom..I dont think they will believe you when you say you thought it was the exit but anyways its what he did that counts...

So... how could you mistake the ladies bathroom for an exit. I believe the bouncer did not beat as severly as you say.
