In some cities there are curfew laws, but they are usually restricted to young people who are likely to commit crimes. Not saying that your friend is a criminal, but your friend probably fits in the high risk age group for your area.
Those laws only come about because of really high crime rates. Most likely, your friend was putting her life in serious danger by being out at that time. |

if he is a minor he should have been in the bed at 2 am. If it was an adult the only way they can enforce this is if a state of emergency was declared and your town was under martial law. |

They can arrest or fine depending on what the city ordinance or law provides for a penalty. I get a kick out of some people's answers on here. Laws are not just created for the fun of it or to get the city money, well I will admit there are a few ordinances that might be mainly there to earn some fine money, but most are directly related to public safety in some way. Cities that have curfews have them for a reason. The regular patrol officer does not see any of the fine money he/she gets paid the same if he arrest 10 people or 1 person a shift, they are just doing there job. As one person said consider yourself lucky you could be in a place under a 24hr curfew and the punishment is being shot if found out when or where you shouldn't be. |

Curfews are put in place for two main reasons. One is because there have been a rash of crimes, usually vandalism, that they suspect is being done by younger groups of people 14-17. So they put a curfew in place to see if it dies down at all.
Another reason may be that the police may have had reports of younger kids being approached by suspicious people after dark and want to take away the possiblity of a rape or kidnapping by simply taking away the prey.
My town has a had a curfew for years and it was because of a rash of vandalism. |

A federal judge in Chicago struck down a curfew law a few years ago, but I think it was on very narrow grounds, so many curfew laws that didn't fit that narrow case still stand. |
