Can cops give me a dui if i was a mile away walkin fro the car?

thay was some other guy with me in it driven he ran i think i didnt know where the keys was to the car untill i went to get it back the next day or anything all i knowed i was in a 10 foot hole and had to walk a mile tryin to stop cars befor someone called me any help i got one guy to come to his house door and tell me to go try some other guys house for help on down the road all the cops did was looked in the car and seen blood on both sides of the insides of the car that was there because iwas tryin to find my flash light and phone

They are not required by law to see you driving, they are only required to prove in court you were driving. The obvious inference is the car got there somehow, and so did you.

Sometimes you can establish who is driving by comparing any injury on the person to damage in the car.

You mentioned there was blood. It is also common to have hair left behind where there is impact with the dashboard or windshield. Depending on how in depth they want to get, it is possible for the officer to take blood and/or hair samples to determine who was sitting where when the vehicle crashed.

It depends. If they have a video of you smashing your car into a tree, and then staggering down the sidewalk, then you can get a dui. They have to be able to prove beyond a reasonable doubt that you were drunk when you were driving the car. Maybe you got drunk after you left the car. Maybe you left the car somewhere, and when someone dropped you off drunk to go get it, you realized you didn't have your keys. The burden of proof is on them. If you were actually driving drunk, then hopefully they'll have some good evidence to get a conviction.

i would have thought so, but i guess it depends....like, if you left the car roughly parked half in a ditch on a main road running through 10 miles of forest, then yes they can, and will, and should.

but if you had the car parked correctly in the car park of the pub you had just spend all day in and were walking towards your home, then id say no, they shouldnt.....but they still might :(

If you smashed up the car and left it there yes. If you was responsible parked the car and walked home NO. Just public intoxication.

Yes, they can. At least a quarter of the DUI arrests I've made have been of suspects away from their cars. I've never lost a case yet.

how can you be charged with a dui if you weren't in your car? you're either driving it or you aren't.
