Can i get an MIP if i'm at a party but don't drink?

like a month ago i was at my friends party and the cops busted it and i got an MIC. my parents hired a lawyer and i have a court date in a month, and i'm pretty sure i can get it off because they didn't test me. I can't tell you why the cops showed up, because honestly i was to out of it to remember. my parents freaked out and they grounded me ever since, because I'm really not that kind of person.
I'm going to a "party" for the first time since, and I'm planning not to drink, or if so not get drunk at least. It's not really a party, just 10-15 people at my friends house hanging out. If the cops show up are they allowed in? If it's not too loud they won't come, will they? How can I prevent myself from getting in trouble, if i get caught my life would be over. If the police do come and I haven't had anything to drink, can I ask them to breathalyze me? I just want to prevent getting in trouble, and I want to know what the police can and cannot do.

You won't like this answer, but I hope you read it anyway.
You apparently have no respect for your parents. You got in trouble because you were somewhere doing something you shouldn't have been. Now you are going somewhere again where you know illegal things will be taking place and putting yourself in a position to get into trouble. That indicates you have no regard for your parents rules or wishes which says you have no respect for them.
The problem with kids drinking is that when they get drunk they lose what little, if any, common sense that they had before they were drinking. This is why there is an age requirement. Even people who are of age behave often as if they have no common sense when they drink.
It is nearly impossible for teenagers to be quiet and not attract attention when they are having a party. Just by the mere fact that a party is taking place creates attention. You say 10 to 15 people at a friend's house, well, that usually translates into twice as many knowing about it and showing up. Why? Because teenagers can't keep a secret among themselves. They can keep secrets from their parents, but not themselves. So everyone will know where the party is and want to show up.
It always amazes me that the kids are surprised that we show up. Just the car traffic alone is enough for some neighbors to call the police. The list of reasons of why we get called is endless.
So if you think that you won't get into trouble just because you weren't drinking, maybe. But if you make yourself a nuisance to the police when they come, there are a multitude of other charges the police will use to arrest you and make you not a nuisance.
It's just better to wait. Maybe not as much fun, but it's better. And then you will be able to say you respect your parents. |

As long as you guys aren't loud and causing people to call in about it, they won't show up. They have better things to do then look for underage parties.
The cops can come in if they have probable cause--like a complaint--to believe something illegal is going on in the house. Again, don't do anything to tip them off. Keep the music down and your friends under control.
You could ask the police to breathalyze you, but they probably wouldn't because you're trying to get out of a charge. Any minors around with alcohol is an MIP.
The only way you couldn't get in trouble is if you aren't in there. Everytime you go to a party, it's a risk...are you willing to take it? Is it really worth it? Ask yourself. |

Unless the cops receive complaints, they won't show up. The only way to prevent being punished is to not go or not be stupid if you do go. They can still ticket you even if you do not drink just because you are there . |
