Can i get arrested for smoking weed in my backyard?

It's called plain view exception to the warrentless search, if a neighbor on their own property sees the violation they can call the cops, if the cops visiting your neighbors with their permission smells the pot from your yard they have caused to investing the smell, if you run it gives the police cause to chase and detain you

if a cops sees you smoking pot or smells it from a place he has a right to be outside your yard in neighbors yard he can arrest you how small is your back yard are the neighbors right on top of you?

If you are doing it in your yard and your yard does not have a privacy fence, then you would be "in plain view" no warrant is needed to arrest you for something seen in plain sight or view of the officer. If the officer sees you smoking it from the sidewalk or a neighbors property that he has permission to be on, and then you run into your house to escape. He can enter without a warrant. If not then he must have a warrant from the court to search. Heres an idea, don't smoke the crap. It is illegal!

i think youre screwed. im pretty sure they can come arrest you even if you are IN your house smoking. legalize it! what a waste of resources. hopefully i wont be getting raped and beaten in my house waiting for the cops while they are at your house placing you under arrest.

Can you be arrested for killing someone in your backyard?
If it is illegal, it is illegal.
They may need a search warrant to enter your home, but they can get one and if you don't answer your door they will simply knock it down, assume that you are a REALLY bad dude and you could be hurt when they find you hiding in the closet.
Try beer. It isn't the same but it is legal.

People have been arrested for using marijuana for pain relief when morphine doesn't work.

The "War on Drugs" is doomed to fail, and only increases the crime rate and intrudes into the lives of good, law-abiding citizens. There is no decent reason to stop people from doing what they want with their own bodies, as long as they don't hurt anyone else?

Sure, you can! It's against the law to smoke bud. If you're caught maybe a verbal warning, or a ticket {money} or jail. Smoke in your house, if your neighbor will call the police.

if a neighbor calls and complains, and i am one of those neighbors if i were your neighbor, they can come up. Then if they smell it they can enter because of probable cause and search and arrest you

well i dont smoke weed but i dont see a problem with it if you want to smoke it in your back yard its your property the cops are usually into smoking weed the cops in my town do smoking weed is not the problem with people its murderers terrorist and stuff like that not drugs people on drugs dont bother nobody they should leave you guys alone!!!

Depends on the state your in some states declassified from a misdemeanor to a health code violation. It will be like paying a ticket. It some where in the area of being like a speeding ticket.

yes you can get arrested due to you smoking it in your backyard they can do you for possession of an illegal drug and if your neighbours do call the cops they have every right to come into your backyard due to they other have to have reasonable doubt that your doing something illegal to be able to act and arrest people. if you run inside it would be to your disadvantage as you are making it obvious that your doing something illegal. my advice to you is if you don't wish to give it up do it some where else or your going to end up with a record

Yes, and they can come in your house without a warrant if they have probable cause ( pot smell coming out of the house, smoke, and neighbor witnes). If they find lots of pot in your house, drug paraphenilia, other types of drugs, then you are in deep sh_ _ _! If you dont want to be caught breaking the law, then dont do it at "plain view"...

here in California I got caught smoking a J in the park. The police gave me a ticket and a court day. I got a fine. It hurt. I still smoke only privately.

I have a question for your question...WHY? Gees, it's expensive, it burns brain cells and stinks. I have known people to loose their homes, family and lots of money cause of it. Every day? I think you need more help than you think, get to the problem you are trying to get rid of instead of sending it up in smoke only to come back the next day! Good Luck.

My neighbor smokes weed and if I smell it - I call the police and report him everytime.
