Can i make a complaint against the police?

i will explain what has happened.
in december last year i was going to work in my van.im a self employed plumber in england.i was travelling down the road,and in front a cyclist justswung out into the middle of the road.as the road was wet ,even though i wasnt going very fast,i decided in fear for the cyclist,to overtake him than slam all on and risk a collision.i did this,and went about 20 yards where traffic stopped,so i didas well.as i was sat there theman on the bike freewheeled to my van,kicked the back of the van,came to the drivers window and punche the window,making the van shake.he then gave me a load of abuse and verbals.he then went on the other side of the road,and set off,all the time giving abusive gestures etc.thinking he could have damaged my van,i foolishly went after him,all the time safely,but on the wrong side of the road for the length of 6 cars.all the time the cyclist was looking back at times and verbally abusive etc.i have a witness to all this.we went over a mini round about and at this point the cyclist,still looking back fell from his bike on to the grass,this happened at about 5 miles per hour.i persued him to get his details,thinking the van was damaged.he got up,i honestly thought hed just hit a curb or a bump.he looked ok,but really agressive,and approached the van,so i turned the van round and went,as i set off i motioned towards him,then turned,it was a drive i was in and could do no other menouver.he had 3 witnesses who said they saw this 2nd part.i got arrested,and this dragged on and through the courts until this week,when my barrister couldnt get the cps to lower the charge and advised me to plead guilty to dangerous driving.im now looking at at least a 1yr ban,community service,a fine.my business will probably go under,i cannot pay my mortgage,will lose m home,its caused incredible stress,my poor wife and 3 children have been through hell,and god knows what else is to come.the thing iv never got over is why the cyclist has never been charged,and i honestly feel its been like a witch hunt.can i make a complaint against the police,or cps.thankyou in advance.

Well it depends what you want to do.

If you want to try and get the cyclist charged with something, then you could contact the Independent Poliice Complaints Commission (http://www.ipcc.gov.uk/) to complain that he wasn't charged with anything. However, firstly it's very unlikely that they'll do anything unless you have significant witnesses that aren't a family member or friend. Secondly, it definitely would have absolutely no effect on your sentence or charge.

If you want to complain about YOUR charge, then after your conviction you may be able to appeal. ( http://www.leeds.ac.uk/law/hamlyn/postconv.htm ). Again though, it is VERY unlikely that an appeal of this nature would be successful.

The fact is, you've already been to court. A panel of impartial jurors have already found you guilty, even after hearing what you've written on here. To be honest, it sounds without question that you were guilty of dangerous driving, and that's what the court decided too. It's unfortunate that it will have an effect on your life and family, but I expect this is part of the punishment and why most other drivers in that situation would have driven off rather than pursuing a cyclist on the wrong side of the road.

At some point, you have to face up to it all. You know if it was dangerous, you know if you were guilty. Take some responsibility, take it on the chin, then pick up the pieces and get on with your life after.

Sorry I can't be more sympathetic.

It does sound like the cyclist shold have been charged. It seems possible however that some of the cyclist's experiences might have happened becuase he got frightened. If you deliberately drove on the wrong side of the road then you must surely see that you were driving dangerously!

You're gonna have to put all this down to experience mate.
You've learned the hard way that you're going to feel the full weight of the law when you lose your cool and go chasing after a cyclist.

In this day and age of road safety, compensation culture etc etc you should know to leave these heated situations well alone.

So let's see, you nearly killed a cyclist who rightly got angry.
Without checking that they caused any damage you proceeded to chase them on the wrong side of the road eventually causing them to have an accident.
And you want to make a complaint????

Come of it - you will be lucky if you don't get locked up.

What the hell have you got to complain about!!!!! You acted like an idiot putting other road users in danger, you deserve all you get. the more irresponsible drivers that are taken off the road the better.
Stop whining and take your medicine.

Unless you can prove there was some illicit reason the cyclist wasn't charged then you cannot complain about the police CPS deciding not to prosecute someone it is obvious by your narrative that you were to one who caused the matter to escalate and put others at risk by your driving.

File a complaint against yourself while you're at it. The Police were doing their jobs while you were driving in an unsafe manner. Chasing a cyclist on the wrong side of the road and over a median in a van is not safe driving. If you had any legal grounds your lawyer would have been able to at least get things reduced. So take responsibility for your actions. It is not the fault of the Police that you are going to suffer for your actions, it is yours.

I don't see where you have grounds to complain. Especially if you're going to plead guilty.
