If you were intoxicated, it doesn't matter if she "gave" you the keys or not. She can sue you for the damage. But you should be more concerned about what the criminal charges against you include on the DUI

She can sue.
If she sued you then the jury/judge would probably take into account that she may be partly responsible to a certain extent, and the judgment against you would be calculated based on that.

Don't know anything about the warrant issue though.

In this day and age of COURSE she CAN sue you. Impossible to tell if she would win; she probably has a case.
Might start talking to an atty; and address that outstanding warrant before it bites your butt.

Best to get yourself ready to go to court and be prepared to defend yourself.

Her being drunk - irrelevant
You being given permission to drive - irrelevant
You being a party to an auto accident - relevant
You having a portion of responsibility for the accident - contributory negligence(your portion of responsiblity for the accident) is the issue here. The insurance company or insurance companies involved will make a preliminary finding and have an opinion on this. You may be sued by her as an individual for damages to her and her property for the potion not covered by her insurance. The insurance company may sue you to recover their costs for the property and medical damages caused by you. The other other party damaged(private or city property destroyed or another driver and car) can sue you as well as their insurance company. You need to notify your insurance company if you have one so they can protect you in this matter. No insurance, ooops,

You will likely get sued by one party(her) if you are lucky and perhaps by multiple parties depending on who has insurance and what was damaged, Try not to have accidents, and please do not drink and drive in the future(not sure whether you said you had been in this accident)

sux that you did the right thing and not drive wasted, in common sense world the answer is no, they got into the accident, there fall its her fault or the other drivers not yours... did she get a dui after the accident, then it is her fault...

Of course she can sue you. It doesn't matter whose car it was. If you got a DUI and she was injured, then she definitely can. I do believe it would only be in the case of injury though. She can't sue you for car damages. Her insurance will take care of her care...if she has full coverage. If not, sorry for her. Your warrant is a totally different situation.

Nobody is asking this question. Was the accident your fault? This absolutely matters. If you were at fault, you bet your *&$ she can sue you, as can her insurance company/companies if they pay anything out which resulted from the accident.

That she was drunk and gave you the keys most likely goes to the relative degree of fault between the two of you, which would reduce or, in some states, preclude her right to recover. Regardless of the contributory/comparative fault issue, she can sue and the case will almost certainly get to a jury, where you have a minimal chance of winning.

If you were not at fault, say if you were driving through a green light and got hit by someoen running a red light, then you should prevail in the end. Clearly, the issue of who was at fault is substantially clouded by the fact that you were drunk.

I sure hope you didn't hurt anyone too badly and that you are learning your lesson.

Your an idiot for taking the keys you shouldve had enough sense to kwno you werent able to handle that kind of responsibility You couldve killed someone I hope htey coem down on you maybe it will teach you a lesson Shes just as much aat fault for givign you the keys unless you implied you were fine to drive. If you had hit my car and my daughter was in the car wiht me you wouldnt have to worry about court.
