My friend got deleted from Facebook for a few reasons, one being that they saw pictures of her drinking form a few months back. She's seventeen. She wants to know how likely it is that the police could do anything about it now. Can they only charge you while you're intoxicated or in possession or whatever? I told her that it's severely unlikely, but if you could find me proof or something... (: Thanks.

I live in Canada, Ontario. Typically I don't like giving out details on the interweb, but I just realized that Americans or Brits, etc have different laws.

My state, my city. Your state and city may and likely will differ.
It is unlikely anything will happen. Can they charge? Maybe. The charge is often minor possession of alcohol, You don't need to test the blood level or anything. if she was drinking from a labeled bottle there is a reasonable assumption that what it is labeled is what is in it.
We used that to close down a club. The club posted photos of clientele drinking from beer bottles. The parents of some of the people drinking saw the photos on the net and complained that their children were only 16.
The liqueur commission felt that the photos and the labels were enough and closed the place down. Other than what they got from their parents we did nothing with the kids. |

In the United States, someone is innocent until proven guilty. If this is the case up north, then the prosecutor is going to have a hard time with this one, as they would not be able to establish time, place, what was being consumed, if it was really your friend, etc. I doubt the authorities would try to persue this. Also, it is doubtful that the cops even know about the pictures in the first place. Finally, building the case against your friend would be so difficult and time consuming, they would not spend so many resources on an underage drinking case. I hope this helps. |
