Our oldest is grounded, therefore he cannot use his car. We felt that it would be a good punishment for him to have to be carried to schoold by his parents. I took the day off from work today to run some errands. So we decided to take the baby to daycare for some hours so I can get things tooken care. So, I decided to ride with my husband as he took the kids because he had to come back to the house anyway.No sooner than he made a right, we got pulled over. Police got his license and registration and went back to the car. My husband asks why were we pulled over when the police came back to the car. I tell my husband to check it because I just saw the brake lights when he was in the driveway. The policeman says to me, ma'am are you saying that I am lying. I said No, I want him to check it so we can have it repaired. Then he says, "Your boyfriend can look at it. I said very kindly, no he is my husband. He says ma'am do you have a problem? What??????!!!!! Then asks me to produce Additional Details identification. No problem. I did so. So, I asked him can I get in the drivers side while my husband checks the brakes. He takes the car keys and tells me to go ahead. That irked me, but I did it. I let down the window so I could hear the conversation and my husband says they are working fine. He tells my husband to stand by the car, and another police car pulls up. After another five minutes, he STILL gave my husband a ticket. The brake lights are fine. My husband just left for work. Do anybody have any idea why we got pulled over with my kids in the car!! All I can think about is a word starting with a p and ending with a g. Comments??

Bring the vehicle to an auto shop and have the attendant do an over view inspection, get a copy of this inspection signed and bring it to court to proof that your vehicle is in top notch condition.
I would advise you to get an inspection immediately after being ticketed. If you have to pay a little to proof your innocent it is worth the cost of the inspection.

The police pulled you over because they suspected you both of something (and it wasn't a brake light). Maybe they were mistaken in thinking you were someone else or someone called in your tag number.
I would fight the ticket.

It's actually a pretty easy ticket to contest if that department uses a mobile video system. You'll have to take the proper steps to get the video for court or if you make a written complaint then a supervisor can review the video. The cop had no idea that your child had been grounded and your husband wasn't your boyfriend. That has no bearing on the fact that you were stopped for a traffic violation. I think you were probably a little more sarcastic with the officer than you're admitting too. |

You were pulled over for a traffic violation, plain and simple. If you wish to contest it you can go to court. Less than fifteen minutes on a traffic stop where a citation is issued and everyone wants to climb out of the car to stare at the lights is pretty quick!
Your son being grounded, driving the kids to school, you decided to ride with your husband, the cop mistakenly thought your husband was your boyfriend...... what does all of this have to do with your question? |

All police departments have certain procedures they go through in every traffic stop to help insure the safety of the officer. That much is easily understandable. However, some people feel offended that they were stopped for a violation and confronted by a police officer and develop an attitude about it. Not a good thing to do. My advise is to politely hear what the officer has to say, calmly explain your disagreement, accept the ticket, then appear in court if you think you have a defense to the charge. In your case, if the ticket was for a faulty brake light and you know it isn't faulty, take the car to a dealer (immediately) and have them check it. If it, in fact, is not faulty, ask them to attest to that in writing and present that document to the court at the time of your hearing. Knowing you through YA as I do, my bet is that you got an attitude about it, right? |

15 minutes is not unreasonable delay.
In my city, we don't have computers in our cars and have to count of dispatch for our information. Sometimes the government computers are slow and it make take a few minutes to check a couple of ids.
It is danger sign to police officers when people insist on getting out of their cars. People can't fight with you if they are seated. It is also dangerous to the drivers. I've pulled people over for burned headlights and some of them want to leap out to look for themselves, and many don't even bother to see if there are cars coming. The fact that another cruiser showed up probably means that the officer was anticipating trouble.
I have a feeling that your disrespectful attitude created most of the problem here. I keep a professional demeanor with everyone, even the ones that are cursing me out and/or being snotty, but...it is my discretion to give out tickets or not and I won't lie and say that the attitude doesn't contribute to my decision. (this doesn't mean I will give out a ticket if the offence didn't happen)
If you wouldn't have received the ticket, you would have said "they stopped us, detained us for 15 minutes and didn't even give us a ticket!"
Take the ticket to court, say that the brake lights worked right after the "offence" and if you can, have a mechanic check them out and give you something to say they are okay.
There is a good chance you'd win this one.

Actually its called DWB...you know what that stands for. I had a similar situation a few months ago. We were pulled over with my son in the car, but we had the pleasure of having 5 cop cars pull us over, to tell us our back tail light was out (which it wasn't). Then one of the cops changed the story and said that the tail light wasn't out, and that there was actually a robbery in the area so that was why they stopped us. They asked us for a receipt from where we came from and everything, which I gladly showed them. Then when they were done, they left. I wish I had of filed a complaint. I sure hope you do. |

Depends on where you are from.
Unfortunately, some police officers are actually overworked. I've seen many of them pull a 24 hr shift - non stop action. They get tired, they get grumpy, and they get tired of dealing with people. You were just a good target for his bad day.
Also, he probably did suspect you for something else - as someone else already pointed out. And it seems like you told your husband to check the tail lights before the guy actually wrote the ticket. You most likely wouldn't have gotton a ticket if you hadn't challenged him. (In his eyes, that is what you did.)
For the next time that you get pulled over - just don't talk. Let the officer and the driver to the talking. Yes sir - no sir. If you disagree with the ticket - after the police leaves, gather proof and fight it.
I actually got pulled over for going straight in a left turn only lane. But, actually the lane was clearly marked for straight and left turns. The other lane was a right turn only lane. But, the trooper wasn't pulling me over to give me a ticket..... :[ Luckily, my x husband was in the car ahead of me and turned around. The trooper left in a real big hurry. (He actually ran back to his vehicle). Now that's a pig. |

What was the ticket for? no tail lights,? right turn on red when not allowed? illegal rolling stop? We have this ego thing in our town and its all in who you know and who you don't know. Its like a good old boys club here and if you aren't a member then you are a problem. I hate this town and the police department that goes with it. I live in township and have the sheriff to deal with and they are just as bad. lots of corruption and the sheriff fires the deputy who wants to run against him in the next election. I just watch my step and bide my time till my youngest graduates from high school them I'm outta here. have a little over 2 years to go, then adios non amigos. |

The police may have had other activity in your area that drew suspicion to your vehicle.
That being said, it sounds a bit ridiculus to me if your facts are correct. As a citizen, I would have had a problem with the whole situation of the ticket if the lights were working.
If you feel like fighting them take it up the chain of command...or better yet; start with the top. The Mayor, City Manager and Police Chief should have to answer your questions. |
