Just wondering, if the driver is not drinking can the passenger in the car drink in the USA? If so/if not is this a State by State thing or is it allowed/not allowed nationally?

Everyone so far has told you mostly the correct answer. Most states have what is called an "open container law" which means that there will be no open/opened containers inside the passenger compartment of the vehicle. This even applies to larger bottles of spirits or wine that have been opened and are now closed. (seals have been broken) these must be transported in the trunk (boot) of the vehicle to comply with the law. But this is not a federal/national law it is state by state. Most states do, but there are some who don't, Mississippi, Missouri, Arkansas, Virginia for example do not.
The Transportation Equity Act for the 21st Century (often referred to as "TEA-21") was passed which is Congress's way to try to blackmail all the states into passing Open Container laws. The TEA-21 takes a percentage of Federal Highway Funds away from those states that do not have Open Container laws. Missouri has staunchly opposed passing such laws. |

Nope. They can get a ticket for Open Container. No opened alcohol permitted in any vehicle. |

It's ticket if an open container is available to the driver. If the driver has, say an unopened 6 pak, next to him or an open container in the trunk, it's OK. Or if it's a limo with a partition, you can have a wet bar in back. |

It depends on the state. Louisiana sells mixed drinks at drive-thrus, driver can drink one too as long as blood alcohol content is within legal limits. |

State by state...in TN, they call it the passover law because the driver can just pass over his drink to a passenger. |

It depends on the state. In my state it's not allowed because basically it's an excuse for the friver to say it's not his, it's the passengers. |
