Can the police arrest you for being in a public street?

near your ex's house, talking on the phone to someone, and not causing any problems.

No restraining order against me
I was at her house eariler to discuss some stuff, and left because she didnt wanna talk..
Then later I see the police there and other emergency vehicles and get worried, so I called her mom to see if she was alright, then a cop called me and told me to MEET HIM in THEIR driveway...and then threatened to arrest me if I didn't leave the CITY! I was staying at my aunts house a block away, and I left after the threat, but have since asked a cop if they can make someone leave the street in front of your house, and have gotten the same "no" answer over and over..its public domain..and as long as no laws or ordanices are broken, then they cant make you leave, but i wanted to check on here..

[restrianing orders] are court documents against the abuser, rapist, stalker, or assailant. The documents order the perpetrator to stay away from the victim and spell out penalties if they violate the order. OFPs and HROs are some powerful friends. Both are an order from a judge (representing The People) to the perpetrator. If the perp violates the order, then it is not just your problem any more. The entire power structure of the county rises up to enforce the order and protect the victim.

so yea, if you violate the restraining order by comming with the proximity of the other person, then it's the police's JOB to give you trouble.

Does your ex have a restraining order or an order of protection? They can arrest you then. And the police would not arrest you unless you were doing something you were not supposed to be doing....

Yeah...for stalking. That IS what you're doing and don't think that most people here are foolish enough to believe otherwise.

Human nature...all the same. Any far fetched and fabricated excuse to deny wrongdoing. You're going to be hung out to dry in court...especially with a silly excuse like that. Get over her for Chrissakes. She doesn't want to have anything to do with you so get a life man.

If you're making a habit of being everywhere your ex is, that would be stalking and yes they can arrest you. Get a hobby.

Sounds like you are violating a protection from abuse order. I've got a question back to ya....if she/he's your ex (meaning you are no longer together) why would you stand in the street in front of his/her home and carry on a conversation on a cellular phone? If I were a bettin' man I'd bet you have a protection order against you which has restrictions about where you can/can't be in relation to the petitioner. If you violated that and an officer has grounds to believe you have you can be arrested. My advise to you is to quit being mean spirited and leave her/him alone. Abide by the orders of the court and guess what....you won't go to jail. Interesting concept

Yes, if they order you to leave the area and you refuse, they can arrest you for disorderly conduct.

There's something you're not telling us. It could be as simple as a restraining order in place. Or your ex could have called the police and asked them to escort you away. Maybe you became argumentative. Maybe the police had to arrest you. We don't know because your question is very vague.

Bottom line, (short of you being caught up in a riot) the police aren't going to arrest you if you are standing there minding your own business.

Edit: So you weren't arrested? But a police officer encouraged you to leave the vicinity. If she didn't walk to talk, that sounds like sensible policing skills. I still think you got gobby with the officer, hence the recommendation that you get out of the city. You may not have been doing anything criminally wrong but, if I may say so, you were acting rather foolishly. Move on with your life.

It depends on the details. Is there a court order? Are you loitering? Are you doing something you know you shouldn't be? The best thing is to just go somewhere else.

Your ex may have a restraining order against you? She may have felt you are a threat being so close.And if you where physically arrested for just sitting in your car close to her house that may be construed as stalking.If you didn't give the police a good reason ,I don't think you would have been arrested.Not enough info here.

no they cant if you really are just talking on the phone and not causing any problems...if they did arrest you then u were causing problems or your ex saw you and decided to be nasty and called the police on you
