Earlier today I was riding down the rode in my car with my friend infront of me in his truck. He squeeled his tires and locked his brakes up and some other things and I drove half on the median to see in front of him. This is all that happened. When we got to my house (2 seconds away from where it happened) a lady pulled up screaming at my friend claiming he nearly hit her child. Her child was getting off of the bus at the time. We pulled around the corner, slowed down and passed the bus, then after we had passed the bus a good little distance, we sped back up. Nothing major at all. This is when he locked his brakes up and crossed to the other side of the road. Here is where things get weird. After that the lady leaves (and after my friend apologized) a cop pulls up. My friend was stuck in my yard because his tire has no traction and so we had to work to get his truck out. Anyway the officer gave him a written warning and nothing was said to me. We work for 45 minutes trying to get his truck out, when we finally do, we both head to his house. When we are leaving, we pass the same officer heading back in. I thought nothing of it until I got a call saying that he was looking for both of us. This entire ordeal has been flipped on me now. Not one person identified my car, not even the lady who was outside. Well I was told to call the officer so I did. He refused to let me talk over the phone or tell him anything. He told me that he is going to try and get my license suspended and get me arrested for reckless driving. He claims that he can get the bus driver to testify and that 16 people called and complained and 2 of the filed a report. He is now saying that I crossed the median (I did put my tires on it) and lost control and that he has tire marks. The tire marks are from my friends truck not my car and the median thing is not completely true. I tried to explain to him what happened but he kept saying that he knows what happened and if he gets me in court then I can tell the judge. Anyway, I am really nervous about what is going to happen. I dont want to lose my license or get arrested but losing my license would be a small price to pay instead of going to jail. I guess what I am asking is, what do you think will happen. The reason why I find it all odd is because 45 minutes later he claimed he got a call as we were leaving for what we did before we came into the place. Why would someone call 45 minutes later is my question. Oh the lady who yelled at my friend filed a report according to the officer. She said the heavier set one with all the facial hair. Well I am heavy with a clean shave and my friend is light with a **** load of facial hair. Everything just seems so sketchy like its more of a thing to scare us out of reckless driving. Please, look at this at a by law view and not a personal view. I know what we were doing was wrong and it issnt going to happen again. Please dont tell me I deserve what ever I get or anything else. The only children outside were ones about 50 feet off of the left side of the road and we were on the right so we came no where near children. I understand that the mother is angry and I would be too but if what the officer is saying is true, she needs to stop lieing. Could someone just let me know what you guys think of this? The school bus was starting to go again but like I saidwe still slowed down and all and a little up a bit is when his brakes locked up (he had started to speed up again and thought it would be funny to brake check me) I believe he would take responsibility so we will see what happens. People sometimes wait a very long time to call the Police. The fact that someone waited 45 minutes doesn't mean anything at all.
In answer to your question - yes, the Police can do this. If he truly has sixteen calls and two parties who are willing to testify, he may be able to make a case for a misdemeanor, in which case he can file a report even though he did not personally witness the violation.
If such a thing happens, it will then be a matter of your testimony and evidence versus whatever testimony and evidence he can bring. Having your friend present and willing to accept responsibility for the tire marks could help you; hopefully your friend is willing to own up for his involvement. |

Bus drivers usually take license plate information from cars who pass their buses.
It's illegal to pass a bus that is letting off children, even if the children are not near your car.
Charges of reckless driving may result in jail time. You will definitely have a fine, and probably lose your license.
You could have killed someone. You should and probably will be arrested. You should and may serve time in jail. |

In your narrative and by your own admission there are a number of vehicle code violations that you have stated you and your friend were doing.
You never pass a school bus when they are loading or unloading children. Accelerating a vehicle then slamming on your breaks is unsafe and placing other motorists as well as pedestrian traffic at risk.
You were driving on the medium by your own admission and with 16 complaints and two written reports it is obvious that reckless driving goes beyond an infraction In California 23103a is a misdemeanor. 21701 cvc Interfering with other drivers on the road or highway. 21703 cvc following to close. 21750 cvc failure to pass safely. 23109c Exhibition driving.
There are a number of other violations that you can be cited for just based on your story, so in the end it will be up to the judge to determine your punishment. |

First of all, you're not going to jail. Secondly, it is illegal to pass a school bus when its red stop sign is out. I'm assuming it was, because you said the lady was upset that you almost hit her child. I don't think you'll lose your license either. If anything you will have to pay a fine. |

This will be a lesson learned not to screw around in a car..no matter how minor you think it is. Cars are not toys.....good luck.
