A summary Charge - no, they contact the parents ASAP
An indictable offense - yes, this is a serious charge and depending on what charge they may be kept until trial and sentencing.

some examples of summary charges are theft under $5000 (in Manitoba but differ on location), destruction of property, loitering , vandalism, etc.. small offenses
an indictable offense is something like aggravated assault, murder or anything involving money in the amount of $5000 or more

Yes, but it depends on what the child is being held for. If on a misdemeanor charge, Social Services would be notified and the proceedures followed from there. On felony charges, the child can be held, Social Services notifed, and from that point a determination would have to be made by the courts as to how the child will be held. If the child is to be tried as a juvenile, then the courts will order that. If adjudicated as an adult, then that will be so ordered. Either way, the arresting agency can detain the child until these matters are resolved through a First Appearance Hearing.

Yes if they have just cause to conduct an enquiry. A 15 year old can commit a crime and be criminally responsible. Therefore he can be arrested and detained. The police would have to inform a parent or guardian, and have them present at any interrogation, but not have to seek their permission

The police can do anything they want, what disciplinary action happens to them after they do what they did is another story.

I would say yes, but would they want to do so, is the question.

Given the damages claim that can be brought against the police should the minor be assaulted if kept overnight, I would suggest that they don't.

Try to keep in mind that law enforcement has many methods to circumvent the rights of the accused ; to the point of rampant corruption these days.. It is proliferated & supported as they take care of their own ; the detectives, the district attorneys office, the judges..... Right to the top.. It merely depends on who and/ or what you are.. And remember females are for the most part exempt/ immune from criminal charges..
