Can the police record you with out telling you during interrogation?

I was just wondering becaus i thought it was against the law to record some one with out telling them, i was not arrested they just said they were takeing me in for questioning and also they let me go the sameday ?

Wow at some of these answers. First off, the rules that govern interrogation and recordings and Miranda laws and all that other stuff are governed by the Constitution, not each individual state. Secondly, to be "interrogated" you have to be in custody, unless you are consenting to a voluntary questioning. Either way it goes, I do not know any officers that would perform an interrogationn inside someones house or place of work. Most all interrogations take place in a police station or a neutral location. That being said, you as a person/suspect have no expectation of privacy in either of those surroundings, therefore you do not have to be notified of the recording taking place. Prior to any interrogation, you do have to be read your Miranda Rights, and not to hurt any fellow officers cases, but I highly recommend you use your Miranda Rights. Shut up and lawyer up, because just about anything you say during an interrogation (including saying nothing) can help the police's case.

haven't you ever seen Law and Order? lol whatever they get you to say is on the record, so they can record you, they can get your fingerprints, they can lie to you to get you to confess something. They can do almost whatever is necessary to gather evidence for their case.

it is generally considered normal police procedure to record interrogations... it depends on if charges were filed against you, if you knew you were being interrogated (meaning if they used an informant), and if you had an attorney/waived your right to an attorney.

Putting a sign up on the premise would meet the requirement of notification, even if you were not told in person.

Anytime you are interrogated by the police you should assume you are being recorded. Exercise your Miranda right to remain silent and don't say a word until you talk to an attorney.

Yes. You have no expectation of privacy when talking to a police officer.

Yes they can record you without telling you. They can lie to you too, for example, by telling you that an co-suspect has already confessed. So I'm guessing they can record you after telling you that they were not. Don't commit any crimes and you should be OK.

YES! Believe it or not they can start recording in black and white squad cars. If your in a interrogation room is one thing and on the streets is another. It all depends on what kind of interrogation is needed for you to confess! Never Rat and Aways Deny to the end.

Hello there!

No the police can not legally record you without telling you. This is a violation to your privacy. And if the do record you with out telling you... they can not use anything against you in court. as they would have to have proof of you saying yes you can record me on the tape. If they don't have this it cannot legally be used.

That depends. If you have been arrested then yes. You have the right to remain silent and the right to an attorney. These rights are given to you as a balance so that the police can do things like record what you say. Once you have been read your rights, the best thing for you to do is to shut up until you get an attorney. The police can record what you say, but you don't have to say anything.

Actually, no they cant. you have to be informed of all the survilence thats on you..

just to be sure, ask what there is!
if they say its not recorded and use it as evidence later ... then it will be trashed!

Once they say they are going to question you the first thing out of your moth should be "I want a lawyer." I see endless tape of people being questioned after they have been read their miranda rights. Get a damn lawyer.

Anything you say can and will be used against you in court....

How do people not get this.

OMFG people stop telling this person lies. If you are in custody you can and will be filmed.
