Was he speeding too?? It doesn't matter if it's his first time. It's a serious offense because a head on colision could easily kill somebody.

An officer isn't going to say "Ok...It won't cost you much this time, but next time it'll cost you ALOT!"

They fine him a lot right now so that there won't BE a next time!

Who knows...They may offer a plea bargain...which would make it cost less.

That's greater than the fine for many criminal offences. My guess is it's a mistake or there's much more to the story!

It could be a mistake. But as California is broke and doing anything to raise funds it is possible.

the way you phrased it implies he didnt actually overtake the vehicle. was he trying to overtake during a turn or when there was not a clear view of potential oncoming traffic? in my opinion the fine should be more if it happened when sight of potential traffic on the other side is not clear.

If they got him up on multiple charges, absolutely. Failure to obey road signs (double yellow), reckless driving, aggressive driving, failure to yield right of way, reckless endangerment. They can also take your license on a first offense and throw you in jail or make you walk home as your vehicle gets impounded. The police don't care if it's your first offense. That is why you went through drivers classes and had a provisional period that you'd have to drive with an adult w/ experience....they expect every driver to use common sense and follow the laws. No matter how much experience they think they have.

Call and ask tomorrow if the ticket is accurate. This would be a hard one to fight in court so if it is valid, I would suggest that he pay then try to go to court to fight the points (this is what is going to cost him in the long run...as soon as his ins co catches wind of this, they are going to probably sock it to him)

Of course they can. He should bite the bullet and pay it and just be happy the situation didn't turn out as horrific as it could've as a result of his negligance of the laws.
