a liar claimed he saw my boyfriend start a fire near the firehouse yesterday. can he request a polygraph test to prove he's innocent? will the police department issue it? are they required to fulfill that request? thank you.

thanks officer. i was thinking he could use the polygraph as a tool to prove his innocence to the investigating officers so they will know he didn't do it and move on.

Yes, he can request a polygraph, but it is up to the department to determine if one is necessary.
However, a polygraph would not be admissible in court unless both sides stipulate to it. |

Currently the Lie Detector(polygraph)(PDD) Psychophysiological Detection of Deception, is admissible in court, in 19 states and is open to the judges discretion.
Ohio v Shamara, 2007 opened this question and the Supreme Court followed up with a new validity test of the Daubert Standard. |

A polygraph is not admissible as fact in court because they are not 100% accurate. People can learn how to deceive the machine. They are however a tool police can use to get a general idea of weather or not someone is lying. The results of a polygraph are interpreted by the operator and may prove inconclusive. Not many departments can afford a machine as they cost several thousands of dollars. Usually only a few members in the department are trained to be operators. The operators are extremely over booked. |

This is your second question on this.
Police departments routinely use "Lie Detectors" ( there is no such thing) in making decisions in whether to prosecute someone. If your boyfriend thinks he could pass it fine, however it does not measure lies and psychopaths can pass them standing on their head!
I guess he can request it if it is ones word against another.
From the line of sight you described earlier it would be fairly easy to challenge the fireman that saw him. |
