my boyfriend was accused of starting a fire on a boat by a firefighter who claims he saw him do it! he said he saw him from the firehouse but the boat isn't even visible from there. my boyfriend was with me at home when it happened. he had just gone to mcdonald's and came home afterwards. is there any way to get a new receipt to show he was far away when it happened? and can you be prosecuted if there is no evidence and 5 people that say you weren't there when it happened? btw, the firefighter is a young, rude, arrogant guy and clearly was lying about seeing him there.

The burden of proof for arrest is probable cause. The burden of proof for conviction is beyond a reasonable doubt.
It is up to a judge and jury to decide who is more credible.
The receipt from McDonald's is worthless, it will only say someone was there, it will not state who. |

No evidence?! There's an eyewitness account from a respected member of the community--AND the fireman wasn't even on the boat with your boyfriend but was working! Plenty of evidence! Yeah, he's clearly lying. What motive does the fireman have to lie? Because he's "arrogant and young?" Your boyfriend better get that receipt!

Well hopefully McDonald's cameras were running that night and he is on them. As far as a receipt, that may be possible... I am not sure how that would work. Also the server at the McDonald's stating that he was there at the time of the fire will help as well along with your testimony of his whereabouts.
