Hello all~~
I just got a speeding ticket today (ughh) and the officer assigned a court location...if i try to postpond/delay the court meeting, can i change the location? I know that we can postpond from the date and time indicated on the ticket, but what about court location???
Many people said that if i keep postponding and moving the court location to some where far, then the officer may not want to show up..and i win...lol

First off, you cannot change the location. If that were possible people would be changing locations all the time to places no one would go to.
Second, the people telling you if the cop doesn't show up they dismiss it are wrong. All they do is reschedule. This is a bad myth repeated by morons who don't know any better. The city wants your money and are not going to dismiss it simply because the cop didn't show up. And remember, when you fight and ticket and lose, and you will lose this one, you have court costs added to your fine and you cannot go to traffic school.
Pay it, go to traffic school and it won't be on your record. |

No, you would not be able to move the court location. The only court that has jurisdiction is the town in which you were pulled over in, or the county in which you were pulled over in.. no where else.
Actually, you have no say in when the date and time of your court case are. You can request delays, but they do not have to be granted. It is solely up to a judge. The judge is not going to allow you to continuously change the date and time, and may not even grant a postponement.
It is also urban legend that you automatically win if the officer doesn't show. A few things can happen when an officer doesn't show. The judge can use their police report as a means to determine your guilt or innocence without the officer. The judge can postpone your hearing until the officer can show, or the judge can completely dismiss the case. Don't think you're going to get out of it simply because the officer doesn't show or you think you can change the court date when you have no real say in the matter in the first place. |
