Yes. I cited someone for that violation just the other day. He was stopped directly in front of the arms and I was directly behind him. The only reason he could give me was that he didn't feel like sitting there while the train passed. |

Yes. Depending on the state you are in, you can go through a crossing with flashing lights and no gates if the train is a safe distance away. But, if there are gates and the gates are down, it is illegal to go around them, whether a train is coming or not. |

California Vehicle Code 22451. (a) The driver of any vehicle or pedestrian approaching a railroad or rail transit grade crossing shall stop not less than 15 feet from the nearest rail and shall not proceed until he or she can do so safely, whenever the following conditions exist:
(b) No driver or pedestrian shall proceed through, around, or under any railroad or rail transit crossing gate while the gate is closed.
VC Section 22526 says that you can get a ticket for stopping on the tracks |

Yes it is failure to obey a traffic signal it is the same as running a stop sign or red light. In the state of Washington it is a 112 dollar fine. AND YOU CAN GET SMOOSHED BY A TRAIN! |
