Yes you can it is a civil ordinance in most towns. The headphones impair your hearing to emergency vehicles. And yes the radio blasting is a noise ordinance in mos towns also. Sorry it's the law. |
|

JESS

some states have a 'noise law' that prohibits loud music in your car, because of 'harassing' the enviornment. and i think it may be because if someone needs to get your attention and you are listening to music, you may not notice them. |
|

Ally :]
 |
im not sure about the ear plugs but i know you can about your stero being to loud.
they'll pull you over in SC for that. |

Well the radio blasting could get you a $50 public nuisance fine, but your ipod is okay. Wish they'd make those damn cell phones illegal to drive and talk on in MB. |

It is illegal in most states to have ear phones on while driving. You should be using all your senses keeping safe. And yes you can get a ticket for having the radio blasted. |

"Driving with Headphones: There is nothing in the Michigan Vehicle Code that specifically prohibits driving with headphones or earbuds. A driver could, however, be cited for careless, reckless, or failure to yield to an emergency vehicle if a police officer could show that the headphones interfered with the driver’s ability to safely operate the vehicle. Some other states do have prohibitions against headphone use." quoted from the Traffic Services Section, Michigan State Police, Field Update. |

In Ohio no you can not.
4511.84 Earphones or earplugs on operator prohibited.
(A) No person shall operate a motor vehicle while wearing earphones over, or earplugs in, both ears. As used in this section, “earphones” means any headset, radio, tape player, or other similar device that provides the listener with radio programs, music, or other recorded information through a device attached to the head and that covers all or a portion of both ears. “Earphones” does not include speakers or other listening devices that are built into protective headgear.
(B) This section does not apply to:
(1) Any person wearing a hearing aid;
(2) Law enforcement personnel while on duty;
(3) Fire department personnel and emergency medical service personnel while on duty;
(4) Any person engaged in the operation of equipment for use in the maintenance or repair of any highway;
(5) Any person engaged in the operation of refuse collection equipment.
(C) Except as otherwise provided in this division, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree. |

Not for the Ipod headphones but blasting your speakers is considered a "disturbing the peace" especially at night and can get a pretty handsome fine. |

Its different in each state. Some states have headphone laws, and some don't. I doubt you would get pulled over for it even in the illegal states and get more than a warning.
In Florida: "No person shall operate a vehicle while wearing a headset, headphone, or other listening device" Section 316.304
In Cali: "A person operating a motor vehicle or bicycle may not wear a headset covering, or earplugs in, both ears" CA Vehicle Code Section 27400
Also, you might be found at fault in accident if you could have prevented the accident had you not been wearing headphones. I don't know michigan well enough to answer that, and your best bet would be to ask an officer next time you see one.

you shouldnt have anything in your ears while driving...and i mean LITERALLY in your ears. if you want to listen to your ipod then how about get and adapter so u can listen to it over the radio? They can have some cheap ones for like 10 or 15 dollars, but others can be more expensive as well. and radio blasting is fine, as long as its not SOOO loud you can't hear anything outside of the car, like a horn or whatever, but i doubt one could even go that loud. |
