Speeding is not considered a jailable offense, that's why you're allowed to post your drivers license as bond. Even though speed limits are absolute, I have never heard of anyone being stopped for one mph over the limit. I have heard of people being cited for two mph over the limit, but that is not common.

Of course you can, think of it this way
Set speed limit 35 if your going over that limit, your speeding, but a police officer usually wont bother taking action against you if you are going 1-5 miles over the limit, but above that the officer may stop you. |

I am not sure you could get arrested just for the 1mph over, but if you get stopped and you are drunk, or if the police find out that you have a warrant out for your arrest for another reason they will for sure execute the warrant. |

Most speeding offenses result in a ticket, for which you can just decide to pay the fine, or contest the ticket and appear at a hearing. Unless there is something else out there like a capias or warrant for something else. It is possible to receive a ticket for going 1mh over the limit, but most agencies will not pursue this. |

Listen up, no one gets arrested for travelling one mile an hour over the speed limit. That is impossible, you can only get a verbal warning, written warning, or an infraction which is a ticket that you have to pay. Being arrested involves either of the following two things, being taken into custody and brought to a police station for processing, or given a summons on the scene which makes you go to court at a later date. |

No. In Pennsylvania, no, because the law states that you must be given a 5 mph grace zone or cushion before you can be pulled over. If I do find you were speeding at a much higher rate of speed, yes I can "arrest" you for it. It is done by issuing or filing a traffic citation. Rarely do I take someone directly to the magistrate. You can be taken immediately before a magistrate if you are NOT a resident of Pennsylvania. |

No. It is NOT a offense worthy of arrest. It can however be worth pulling you over, a ticket or warning, then that opens the door to searching your vehicle for drugs etc...but with the basic question of being arrested, NO. If you have a suspended license, restrictions, bad plates etc...then it could be, but for driving 1 mile of the limit...NO. |

you dont normally get arrested for speeding unless you start back talking an officer or if they find something in your car. maybe if they run your license and they have a warrant.. to be honest normally you dont even get pulled over for doing one mile over. i have a family of nothing but cops, and they dont start pulling over unless you hit atleast 5 miles over the speed limit. people cant help a one mile difference over the speed limit |

It's not the speed that will get you arrested. Usually when a cop stops someone other things come up that causes them even more trouble. Alcohol, drugs, bad attitude (failure to resist) etc,...... Just stay calm and collected. Have your valid license and proof of insurance. Good luck to you! |

You can not get arrested over a traffic ticket. Each state has their own laws that says if you are going over a certain speed limit by so many MPH you can be arrested for Reckless Driving. If your doing 140 in a 55 zone ....Your going to Jail. 1-30mph over is just another day in court. If your going way over the cop is already pissed and I hope and pray that you have no warrants......If so your taking a nice little ride. You can also get a ticket for driving too slow. Like in Iowa where they practice tandeem driving. |

No, but if the cop wants to be difficult he/she could give you a speeding ticket.
You have to be going 25 mph over the speed limit to be taken to jail (Texas).
I actually got a speeding ticket for going 90 mph in a 65 mph zone. The cop didn't take me in but that's what he told me. |

I think there's a misunderstanding here....a "summons" or traffic ticket IS an arrest whether 1mph or more. Officers are smart enough, however, to understand that we ALL make mistakes and sometimes travel a little over and under the speed limits unless we've got a good cruise control system on board. As such most agencies have a policy that allows a threshold of 5-10mph over the limit before a summons is issued. That doesn't mean you can't get stopped for speeding unless you exceed those thresholds...just that NORMALLY only a verbal warning is given!
Once you sign your ticket, you are essentially doing two things:
1) Promising to appear in court (or pay the fine).
2) Being released to your own recognizance on a "signature bond."
Refuse to sign a traffic ticket....guess what...you go to jail! |

All traffic stops are an "arrest". However, in then context you are thinking of, you can be arrested for any violation in the state of Missouri and taken to jail to post bond. Speeding, seatbelt, littering, ect. To the poster above, we are coming up with this, because it is there. Signing a ticket is a promise to appear before court in lieu of posting a bond. This is how it is usually done, but the option to arrest is certainly there.
As for going 36 in a 35. As I said, it is certainly is possible, although I have never seen it done. If someone said something like "I'm not going to pay this", then I would take them and make them post bond.
In reality though, it is very unlikely that you would be stopped for 36 in a 35. Most radar and lidar units have a stated accuracy of +/- 1 MPH. So you don't want to pull over someone for one over to begin with. A good defense attorney will simply argue you were within the margin of error. Pacing is a bit different, as with vascar, but there is still a margin of error. You want to give people the benefit of the doubt.
Personally, on a 35 MPH street, I probably won't stop someone unless they are going 10-12 over. |

Yes you can. For traffic violations you are issued a traffic citation that is a NTA (notice to appear).. hence is a form of arrest.
Now in all actuality you probably are not going to be handcuffed and transported to a jail for processing. To much time. paperwork, etc... for such a minor infraction. By law you can be issued a citation for 1mph over, however, most officers will not mess with it because if a competent judge realizes there are variances in odometer and most of the time it's impossible to judge 1mph difference on a speedometer. |
