Can you settle this argument about driving while license is suspended?

ny brother got caught driving on a suspended license in ca. as a result his car was impounded for 30 days. now the fool wants to move to mt. id.or nv. because he says that even though his license would still be suspended they would not impound his car for 30 days, in fact he claims that he would get cited and be able to drive away.

i think that they would at very least tow the car only to be released to a licensed driver, but i also thought that the 30 day hold was nationwide.
please don't ask why he doesn't get his act together and take care of his past due tickets it will only start another argument

I've never heard of an officer allowing someone without a license to drive away.

First of all, the officer can not give you permission to break the law. Secondly, if he does allow you to drive away, and you get in an accident, the officer can be held liable.

I think the problem you're going to have with this question is that you need someone in each of the three states to give you answers. So far, I've never seen anyone specifically identify themselves as being from any of those states....at least with any kind of credentials I'd accept.

Even if you can find someone in those states to give you an answer about their state, chances are the reason(s) your brother's license is suspended might make a real difference. We suspend a license in this state for a bunch of different reasons and a reason to suspend in California may not be a reason in any of the states you mentioned (for instance, we suspend a license in this state for being behind in child support payments...does not make sense to me...but maybe one of these other states does not do that).

If those states have a 30-day law, then your brother is a fool for thinking he's going to somehow be immune to it. That said, even if they do have the 30-day law, it's always possible he would be cited and left there on the side of the road with his car...nobody can predict what a cop will do, especially if your brother was exceptionally polite and cooperative. Unless there's a state that *mandates* a 30-day impound, there's always the possibility that he'd be cited and told to find another ride.

It doesn't matter what state you drive in or move to. The citation or suspension will be upheld and in place in the state that it was given in and will show up in other states. Best thing to do is pay the fine, wait out the 30 days and move on. Take care of it and don't let it turn into a warrant.

No license means no insurance. If stopped, the vehicle would be towed and he would be walking. This is why police ask for license, registration and proof of insurance at traffic stops.

If he has a suspended license, he has NO license.

If he gets caught driving without a license, he's not going anywhere in any car.

I live in Kansas. I got caught driving on a suspended, and I got a notice to appear and was told to call a ride. Because I got pulled over in a parking lot, they didn't tow my car. Something about it being on private property.
