Recently i found out that my sister stole money from my account to pay for her cell phone bill which was 1 thousand dollars when I asked about this I was informed that she was also sharing a line with her friend who doesn't help pay for the bill. They don't live together and aren't family, now if she was blackmailed or pressured into stealing prior to this incident can I press charges against this other girl as well ? also due to this I will be missing a surgery I had a down payment on and will have to pay 500 towards that date so now im out 1,500 dollars if anyone knows any laws or something pertaining to the federal or state of California's laws please email me and help me figure out how or if I can prove that this older girl pressured my sister into such a low deed (Im saying this out of context but my sister is no spring sunshine she has done one other crime when she was 16 she carried some stuff out of a store for a friend of hers and got caught with it and hence got the punishment while the other girl was allowed to go free making my sister a per-ma tool) Now I've pressed charges hoping this will help my sister but I don't think it will I also want this other girl to be taught a lesson as well. Please only serious answers and if ur gonna criticise please reconsider. This is a serious issue that is very personal to me.

How did she get money out of your account?
Do you have a written agreement with your sister that she will pay her portion of the phone bill?
If not, you will not collect a dime in court. |

You sure can. You would have to file it in Small Claims Court. There is a fee involved ($25.00 give or take) and court costs, but if you win you can get that back too.
The problem is without some sort of agreement on paper it becomes a case of "yes you did," "no I didn't." Without a witness to verify that you agreed, there is not much of a case. Always, ALWAYS get something on paper. Even if its just a scribbled note that says "I promise to pay half." Notarized is always better, but I've won with just a note before!
Dad used to say "friends are great, until you add money into the equation." That can apply to anything!!! And is very true!
