Car accidenet but didn't report to the police?

We had a car accident about 2 weeks ago. It wasn't very serious. A lady hit us from the back while it was red light.

She apoogized and asked us not to go through her insurance because she wanted to pay for the repair out of her pocket. We wrote down her license plate number and all her insurance information but we didn't call the police.

After we got an estimate of the repair, we faxed her the detail of the estimate and told her to get another esitmate if she wants. She said our estimate was too expensive. We told her we would go to her mechanic if she wants as long as we can get the car fixed. Now, it's been a week after we faxed her and talked to her, we tried to contact her couple of times and left 2 messages in her cell phone but she hasn't called us back yet.

I'd like to know, since we didn't call the police, when we contact her insurance company (GIECO), will it pay for the repair?

You should always have an accident report made to cover yourself. Insurance companies are not notified by the Police. It is up to you. You can try to contact her insurance, but something tells me the information she gave you is bogus. Go to the Police station, and explain the situation. Maybe, they will still make a report.

yea they will pay for the repair, furthermore if u inform the police and told them that the lady said this to u then another case will be filed against her!

I am not sure on this but I would call the insurance company and talk to them and explain the situation. If it comes down to it you might have to take her to court which you will probably need legal advice on that could cost you. If they find her guilty she will have to reimburse you for legal fees if you state that in the court claim. Good Luck!

Ok, can you say, I have been cheated ??

It is very possible that she did not have a drivers license and very very possible she has no valid insurance, this is what normally happens when they dont want you to contact the insurnace and not call the police.

But you can always contact the insurance company, or sue her in small claims court. Without a police report it will be harder to prove your case, but you still can try.

A friend of mine had a story similar to yours. I would tend to say no since you did not file an accident report when it occured and you did not report it. If you are to pay for the accident from your own insurances and the other one doesn't pay anything from her own insurances, it would be similar to a hit and run...

The best advice is to contact your insurance company and explain the situation. There is something a little fishy about her not wishing to involve the police or insurance companies.

You don't need to pursue her insurance company, and it is likely that she did not in fact, actually have insurance. Contact your company, and let them handle the situation. This way, you can relax, and know that somehow your car will be fixed, even if your insurance pays for it (in the case that she lied about having insurance). They're experts in this, and things like this is why you have them.

Another wise idea, always take pictures at the scene of the accident, whether you call the police or not. Camera phones work great and are easily accessible. There's always a chance that the person will claim that your car had some of that damage before they hit you. Always take pictures, even if it's just for your own records, because they can save you from having to pay for the repairs yourself.

Do not call her insurance company call YOUR insurance company and give them the info. That is what you pay them the big bucks for. Make them do the work, give them all the info and they will go after her or her insurance company. BUT here is the problem, without a police report it is going to be your word against hers. She can lie and claim that there was very little damage and that you must have been in another accident afterward or make up who knows what for a story. In my state you get a police report for anything over $1000. If you have over a $1000 and fail to report it to the police you are comitting a crime whether both parties agree to do it this way or not.

While I can understand one's desire to avoid contacting their insurance company and having their premiums go up, anyone agreeing to this is setting themselves up to get screwed (not to mention breaking the law if there is reportable damage) When you made this agreement with her you entered into a verbal civil contract. The police will not get involved in that part of it and although they might attempt to take a "late report" accident it will be hard for them to do two weeks later. If her story and your story does not match up how is the officer to know what is true now. There is a reason why you are supposed to report the accident when it happens, so the police can investigate the scene and report the facts not just what someone says two weeks later.

There is no doubt that you have a good civil case against this person but it may be quite an involved process now. Again call YOUR insurance company immediately and see what they will do.

Sounds to me like this lady does not really have insurance, If she did , she was probably trying to avoid paying a deductible as the accident was her fault and she would have gotten points on her license or maybe she has a real bad driving record! Well anyway I would call her insurance . They should pay even if the police were not called. In most all states you do not have the call the police if it appears that there is only 500 dollars or less damage!! You will not get in trouble for not reporting to the police if it turns out to be more than 500 dollars. My daughter hit a car backing out of a parking space, broke the light and a slight scratch, looked like nothing, the police were not called. It turned out costing 1,500 dollars to repair! Nope. You are legally required to report an accident-usually within 24 hours. You didn't and the person who hit you is not going to pay...you are royally screwed but have learned a very valuable lesson.

In Indiana a report is required only if there is over $1000 worth of damage. If her insurance bulks, you will be stuck with the cost (your insurance may cover it under comprehensive)


Sounds like she fleeced you. You may have to take her to small claims court.

You still have time to report it. She is the one who hit you from behind. It is her fault. SO let her know that she hit you and you did not hit her. Deal only with her Insurance Company. In our state you don't need to involve the Police if no one was injured. Yes, her Insurance Company should deal with you. Not her. Are you sure she has Insurance. Probably she is stalling and does not have adequate Insurance. It's time, you become the investigator. If she does not have Insurance, then let her know immediately that you will file suit against her and she can then be charged for no Insurance and not reporting the incident. She needs to pay up.

Turn it in to your insurance co. and stop fooling around. They will go after her. You don't need a police report for damage under $750.
