you were provoked by the jack@ss. i would have done the same thing. i believe that the charges will be dropped. if not, and it goes to a trial, i believe the judge will realize it and let you off very easily. and judging by your spotless record nothing major will come out of this even if it doesnt go your way. thanks for helpin out the less fortunate and for hitting the guy in the face. he deserved a lot more |

Worst case scenario you will lose the case and be fined a not too terribly substantial amount, maybe two or three hundred dollars. I would not spend much on a lawyer but if the case comes to court go there and calmly present the facts as you have here. This man is a hothead and will prove it in his remarks to the judge. He will become angry about the homeless man all over again and his demeanor and ire will be evident. I have been in a similar situation and simply waited for the other guy to explode and he did. I won the case but it always depends on the judge. The law is simple, if you assaulted him it is assault. The question becomes whether his verbal assault, complete with spittle was also an assault and therefore you were defending yourself. Good Luck! |

I am sure when the judge and jury will hear this story they will be TOTALLY on your side. You have nothing to worry about. Don't pay him any settlement to close charges.

The man threatened you. He invaded your personal space in an aggressive manner. If he pointed a finger in your face or lifted a hand above his waist even to gesture, it seemed to you at the time, because of his aggressive demeanor, that he meant to strike or otherwise lay hands on you. Your intent was to get and keep him away from you. |

Call the police, if they have have not been contacted already. You would need to give a statement along with as many people that witnessed it as possible. Having someone spit on you is an assault charge. Think about all the diseases or viruses that can be passed from bodily fluids. Hitting the person to avoid that transfer of fluids sounds like "self-defense" to me. As long as nothing else happened, and the man was not hurt seriously, there should be no issue at all.
One thing to think of. Citizens don't press charges. Police do. I have been to fight calls where I look at both men and said "grow up and go home." If its not worth charging out the police will squash it. |

i had a similar situation ,i live in los angeles my situation was i was going to work a car pulled in front of me i stopped the person just sat in his car i rolled my window down told him you go or i go he came out of his car by the time i tried to get out he hit me in my face then he tried to take my car keys well by that time i was so mad that i ended up beating him so bad the only way i was stopped was by to cops putting me in a choke hole even then the cops had a hard time i ended up headbutting the cop. anyways i had a witness i didnt no he saw the whole thing first you could of pressed charges on him for spitting on you and threating you , good job in punching him out just to let you know i did get a ticket for missdomener assault when i went to court the district attorny just dropped the case cause it wasent my fault. good luck |

its called "VERBAL ASSULT" they guy provoked you, write how everything went down as to not forget any details, and counter sue his ***....get witnesses and press him with charges...he provoked you so you should win, but you'll also lose in his suit because you did hit him, so consult a laywer.... |

like what the rest say if you can the Homy Guy w/ as a witness and ask mercy for consideration to the Judge for the insult you also get for your good deeds i believe that a ''just''justice will be on a fair judgement and merciful be Polite and ask your highness pls. dont charge me much but if i have to pay a price pls. send me to a community service(you can ask this or not its up to you) as penalty to my felony because the reason was i being provoke humiliated by my charity and i expect your honor that charity will also been given to me by this court |
