Could I get arrested?
|
So I had a domestic dispute with my boyfriend where he asked for something out of my purse. I said no, he couldn't have it. I put the purse in my car and turned around to say good-bye and he jumped into my car and demanded it. I then said no again so he took my purse and started digging through it making sure that I couldn't get to it. He threw my purse on the car a couple of times and picked it back up. Of course this whole time I'm trying to get my purse back. His mom came over to create a barrier between her and I so I was grabbing around her. Then something happened where I finally got my hands on the purse and somehow both of us toppled down a hill where I got scraped up pretty bad. The police asked if me to write down what happened to the best of my ability so I wrote down that he pulled me down the hill. After that, another officer told me that there might be cameras to look at and if there are and the story was flawed at all than he would arrest me. I a little scared because I told them that I wasn't sure what happened a thousand times and they made me write a statement anyways and now they are saying I could be arrested if what I wrote wasn't correct.

The answer is that of course you could get arrested for this...police misinterpret things and misapply the law every day.
However, as you describe it, there doesn't look like grounds for an arrest. What you told them doesn't rise to the level of intentionally misleading police to allow yourself or someone else to evade prosecution.
So, what happens is you get arrested anyway? Hopefully, you bail out and get an attorney. Now, they either have the video or they don't. If they do, your lawyer can get a copy of it, the two of you can look at it together and compare it to your statement, and make an intelligent decision as to whether to fight any charges they lay against you.
If they don't have any video, their case is so flimsy that you have a chance of getting it dismissed outright. If you have to go to trial, you would probably win.
Most likely, they were just trying to intimidate you into changing your story, on the hunch that you had lied in your statement. But minor inconsistancies are to be expected, they are not grounds for prosecution on their own.
And the moral of the story is, don't give a statement where you might be charged with a crime without your lawyer present! |

Well, I doubt you will be arrested. Probably just given a citation for a false statement. More that likely, though, any charges pending against the BF will be dropped because of your false statement. If you are cited and have to go to court, your defense could be that you did not want to write a statement but the officers kept hounding you for one until you wrote what you think they wanted to hear.
You can also amend your statement. Telling the officers that you were confused and frightened when you wrote the first and made errors in it that you want to correct. |

its highly unlikely to get arrested because criminal investigators and prosecuting attorneys know that things happen so fast that it may take people a few days to realize what happened. i wouldnt worry about a mistake you handed to a uniformed officer. its more important if a criminal investigator or attorney knows exact details. |
