i think i should start by saying...my friend has a suspended sentance for 59 days,for not payig his fines,and he hasnt paid the fines and has warrant out for him by the warrant officers because he has been to court 4 times and been suspended 5 times and court said this was his last and only chance and give him a weekly suspended sentance nd he had to start paying the fine but he didint so the warrant was issued...
the other day he stupidly smashed someone's window and got charged with criminal damage with affray,hes got a court date to go to court and he said hes going to plea guilty,im just wonering if he will get a custodial sentance when he goes to court? if so on average how long would get added on for his 2 new charges,or what will happen in court?
Any help would be great.

Public Order Act s.3 affray; max £5000 fine and 6 months custody. With a history you describe combined with a separate charge of criminal damage it is unlikely he will escape a custodial sentence which will be determined after the court orders a pre sentence report. It is a moot point whether he will be granted bail in the interim. |

He is likely to go to prison. That's what a suspended sentence means in the UK, anyway. When he goes back to court, the fact that he has committed another offence whilst on a suspended sentence means that that sentence will be activated, PLUS added punishment for the new crime. |

My boyfriend went thru the same exact thing actually. He was on a suspended sentence and at that time found out his now ex-wife was cheating on him with his best friend. He broke the guys window out and smashed some tools. He was looking at doing quite a bit of time. He was appointed an attorney and managed to get 2 yrs probation to run concurrent with his current probation. It is possible...just dont jump on the first DA's offer..those are always the worst case scenarios..99 percent of the time, they will reduce especially in the case of criminal damage, even if he has a suspended sentence. I would suggest he gets those warrant fines paid first though.. |
