Last night my roommate(21yrs) and I were out making our rounds at some local bars in a college town and about 2am he was charged with criminal mischief for attempting to break a towel dispenser in the bathroom. He was pretty drunk but was calm with the officers. Just would like to know what kind of penalties come with this? Probation?Fines?Jail-time?Community Service? Also Does he need a lawyer?

This is a minor misdemeanor. I will also add that he was cut quite a break for not being cited/arrested for drunk and disorderly or public intox as well.
If this is a first offense, he can expect a fine, restitution to the bar owner for the damage to the towel dispenser, possibly 6 months probation and community service.
If he has any priors, he can expect some AA classes to be mandated as well.
If he wants, he can hire an attorney. I would suggest an initial consultation ( which is usually free - you can ask over the phone and they will tell you if there is a charge ). The attorney can give you an idea if he can cut a better deal with the prosecutor's office ( usually they can if your friend is willing to pay for damages).

My two cents...
I agree with everything Midnightrider said, except... Criminal Mischief in Ohio is a Misdemeanor of the Third Degree. There is actually a possibility of some jail time with this charge. The summons your roommate got should list the degree of offense on it.
That being said, they are most likely looking at restitution and fines; like Midnightrider said. But if there are priors or your roommate wasn't actually polite to the officers then there may be a day or two in jail for them.
I am also surprised there wasn't a disorderly conduct; intoxication charge on there too. Kind of a no brain-er charge when someone is intoxicated and damaging property. Consider the one and only charge a gift from the officer. |
