The USA is VERY tough.I had a very minor conviction in the 1970's. I had to have my passport sent to Sinapore (from Sydney) to get decision as to whether I was now a good person. I got the visa but it was far from certain.
My guess is your b/f has no chance whatsoever, and won't get a visa for some years to come. I thought my experience was minor and a foregone conclusion that I would be judged suitable. NO WAY. Cancel your tickets - you might get something back if its done before 24 hours before the flight.
I don't see a court processing the matter terribly fast, and anyway, you have to declare if any issues are outstanding. And believe me, if they catch you lying, he won't get into the USA in this lifetime. |

im afraid if your boyfriend helped beat someone up and he ended up in hospital then there are a lot of people on here who are going to say nasty things about him-not once did u mention that u care how the victim is-why the hell would u even want to stay with guy never mind go on holiday with him-he may get bail and then he may not be allowed to leave the country till its over anyway |

OFF COURSE he will able to go but tell him to make the most of it because whan he gets convicted he will never be able to go back.
the only way he wont be able to go is if the court takes his passport away and I doubt that will be the case just for beating someone up ake sure he does not have to answer to bail during the time you are away because then he wont be able to go |

It all depends on whether your boyfriend is allowed to get away from that interrogation room or not. Nothing turns up on his record before there is a conviction, and not all crimes are restrained from entering the US. So just an interrogation is not enough to restrain anyone from entering the US |

If you need a Visa to enter a country they do checks on you. You have to declare any criminal records. Of course you could choose not to declare it, but if you do this then they check, or you end up in trouble with the police while you're out there, you'll be in big trouble. I'm not sure what the laws are, but I would have thought that with this crime being so recent, there's a good chance he will be refused entry. |

If he is convicted prior to the holiday then he won't be able to go, if he is bailed pending a court date or to return to the station he will.
As others have said, I hope he enjoys himself because once convicted he will never be able to step foot in the US again. |

He will need to be convicted first befiore he is liable to be excluded but that is by no means certain. |

He won't have a criminal record (assuming he hasn't committed any previous crimes) until he's convicted, so it should be of no consequence at all. |

Does he have any previous convictions for ABH or GBH? Or any other similar public order offences? If yes, then he may not get bail and may end up going directly in front of a judge and be remanded in custody before his trial (meaning he could be sent to prison for a few months before trial)- due to him being a continued threat to society. If no, and this is a one off drunken bit of stupidity, he will likely be released on police bail pending an investigation and then a trial if the CPS goes forward with a criminal case.
Also, depending on the conditions posed as part of the police bail, he may have his movement restricted - so may not be allowed to leave the country. This is quite rare for ABH/GBH cases though, and is more likely for high profile cases.
The real likelyhood would be that he will be released on police bail and you will be able to leave the country. You would still have to comply with the bail date though (ie. he will have to report to a police station at a certain time and on a certain date).
Also, something to remember here is that ABH and GBH (the latter is the most likely in this case as the vicitim was hospitalised) are very serious crimes and can carry upto a life sentence depending on the injuries sustained and the intent of the attacker. The police may push for your boyfriend to be remanded into custody regardless of a lack any prior incident depending on the wounds received by the victim. |

Well I doubt any criminal proceedings will be concluded by Wednesday so my guess is yes, he will probably be bailed from the police station today to return on another date OR if he makes full admissions in interview he will probably be charged today and either kept in police custody to appear in court tomorrow or bailed to go to court on another date.
The Court/police may be willing to accommodate a holiday but they will want proof of travel. |

Look on the bright side, whilst you are in Los Angeles on your own you might just meet someone who can control themselves without resorting to violence...
Incidentally it is ABH-Actual bodily harm which can carry a prison sentence in some cases... |
