Hi,
My husband was arrested for DWI and Reckless driving to endanger. He hit a tree, no one was hurt or anyone property was. THANK GOD!
He has never been arrested and has a clean driving record. He cooperated fully with the police and the magistrate at the jail.
What do you think he is looking at here?

Ok. Specific to your state...
There are 5 levels of DWI in NC. Level 1 is for people who have multiple DWI convictions or endanger a child with their drunk driving. Level 5 is for the bloke coming home from the bar who swerved a little, got pulled over, cooperated, and it was discovered he had one too many.
Your husband qualifies for a level 5 except for the crash and the reckless charge. He's certainly not a level 1 in my opinion, but I'm no lawyer; just spouting what I learned during a mis-spent youth :)
You can expect to pay about $500 in fines and court costs, and there's a possibility of time in county jail and/or community service. He will most likely lose his drivers license taken away. If his BAC was higher than .16 he will have to have an Intox-Lock installed in his car.
Your next step is to put an attorney on retainer or find a public defender. It is incredibly empowering to walk up to the Judge with a man in a suit who says, "Good morning Your Honor. Atticus Finch, speaking for the Defense." A lawyer worth his salt will be able to plead him guilty on the DWI in exchange for dropping the other charge, a deferred judgment, and probation. |

His DL should be suspended for up to 3 yrs. and his insurance will go up. |

Hopefully, it will be a nice long sentence that will teach him not to drive drunk again. He night not have hurt anyone this time, next time somebody could get hurt or even killed because of him. |

If it were Canada, it would be 6 to 9 month driver's licence suspension about $13 000 in fines and possibly 6 months to a year in jail. And all of that is just for the DWI, the reckless would be additional stuff. Maybe the next time he goes on a bender, he'll take a taxi. |

my cousin got a DWI and other stuff i wont mention, and he still bought his way out of jail time
