Me and my friend went to downtown chicago tonight and got back at 9:30 and when my friend invited me to his backyard to finish eating my dinner that i bought, his racist dad came along and said does your parents know that your out this late and I said yea. Curfew is around 11 and Im gonna go home and then he told me bull ****. I then said it was no B.S. then I started ignoring him and tried to walk home. He then grab me and start shoving me around( hes a 56 year old around that) So then I shove him so he can get off me. he then said Im going to call the police on you and I said why I did nothing wrong, Then i said you did something wrong, you hold me and shoved me and I pushed you just so you can let go of me. My best friend told me he was a racist along time ago but we never had problems until tonight when he lashed out on me for no reason. If he punched me then I would try to defend myself but he didn't (THank God) Im really shaken up and scared. I was even too afraid to call the Cops, because he said he would call them. I didn't think a cop would believe a teenager. My friend is a witness and I don't know what to do. In this case the question is did I get assaulted or is their any law on people shoving and holding you?

Yes you were assaulted. It was minor, but he put his hands on you. It's up to you, but I would call the police and have a report taken. If you are underage you need to tell your parents. You can then decide if you want to sign a complaint on this man. You pushing him back to get him off of you is not considered a crime. Don't be afraid to call the police. Besides, you have a witness. If he said anything racial, it then is classified as a bias/hate crime. |

An assault by definition is any unwanted touching. Yes you were assaulted. He could very well call the police on you too. But he is an adult and faces much tougher punishment. If you have never had contact with the juvenile authorities, then you would most likely be talked to and released without much thought put into it by the authorities. You can file charges against him through the district court commissioner's office without even contacting the police, though it would probably be a good idea to get a report from them asap. |
