Take it to court, they might reduce the fine say 55 instead of 65. You might be able to do a plea bargin. In the best case scenario if the cop doesnt show up at the court date, the ticket automatically gets dismissed. |

if he cited you for speeding-cased closed you lose. doesn't matter what you were driving or if you tried to pass him or not. speeding is a valid ticket. if it is your first ticket you can do traffic school and you won't get the points. |

The thing is, you were doing 65 in the 45. It does not matter what the other car was or was not doing. If you were exceeding the speed limit than you were wrong.
As to whether you have a case about pulling over to avoid an accident rather than to pass, that would probably depend on the judge. But two questions come to mind immediately. If you were only trying to avoid an accident, why did you get rude with the cop rather than trying to calmly explain what happened. And second, why were you following so close that your only option when the other car slowed was to go around it.
I wasn't there and didn't see it and I'm only hearing your side of the story, so I can't really say if you have a leg to stand on or not. |

here in Louisiana driving 65 in a 45 will get you a ticket.even if both of you were going the same speed he looks at it as i caught you.even so the other driver got a way.sorry pay up. |

Even if you were doing 55, you were still 10mph over the speed limit. That isn't a good argument. Plead guilty in court and ask for traffic school.
Once you complete traffic school, the ticket will be dismissed, and your insurance won't go up.
And slow down. If something had happened with that van, and you had run into it, you could have been killed at that speed. . |

You admit it openly that you were driving 65 mph in a posted 45 zone. Why would you think you have a case? You knew you were speeding, the officer knew you were speeding, and the detection device he was using knew you were speeding. |

I'm not sure where your from but I got off 2 fines in Melbourne by writing a letter to say I was distracted due to my dads illness and that I was really sorry, never do it again, blah, blah. My husbands letter said he was unaware of the speed zone and he was just following the other cars. Admittedly the next letter I wrote, they must have cottoned onto me because I had to pay. It might be worth a try though, just explain your case.
Oh, by the way, my tickets were from a speed camera.

When I was driving on an interstate near chicago the speed limit was 45. There wasn't a car going below 60. Sometimes you have to go the speed of traffic, but in your case that is quite controverally the speed of traffic if it was only two cars! |

I'm sorry, but your own explanation tells me why you deserved the ticket. Despite the speeding, you also mentioned that you had to move to another lane in order to avoid hitting the van in front of you. This tells me that you were either tailgating the van, or that you were catching up to the van when it suddenly slowed and not going the same speed as the van (possibly not paying attention to the van?). In all your own description sounds like you were driving aggressively.
On another note...calling someone "buddy" when you don't know them personally (whether a police officer or not) is a blatant sign of disrespect. It's the same as calling someone "chief" or "pal", if you want to get respect then you need to treat others with respect by calling that person "sir" or "ma'm".
As far as the points go....schedule a court date and then apologize to the Officer. He may waive the points, or possibly not show up. Either way, the worst you can get is the 4 points you already have. |

You got caught speeding. Just pay the ticket. It doesn't really matter why he didn't pull over the other vehicle. If you were speeding you should accept the consequences when you get caught.
