Yes - I have been to the ER several times to collect the blood samples for entering into evidence.
You need to maintain the chain of custody for all evidence.

If you were a driver in a crash and taken to the ER the police would go there, with or without alcohol being in the mix. If you are treated from the accident the police (in my state) can also use the info gained from any ER blood draw to get a warrant for another blood draw. The police witness the warranted blood draw for court.
If you are an offender, like you attacked someone and you where hurt by the victim or when you were trying to get away, the police go with you to the ER because you are under arrest. Alcohol related or not.
If you are a youth who is very drunk the police take you to the ER for treatment.
If the hospital personnel believe you have been a victim of violence they must contact the police who come to the ER, again alcohol or not.
Also the local ER is often the only place with clean washrooms in the middle of the night, so police go there. Socially cops hang out with docs and nurses who work ERs since they also see some of the worst of humanity. So we stop by to say hello to our friends. |

PRACTICAL THE ANSWER TO THIS IS NO. Police has no business in going to the emergency room in alcohol related incident if ever there was involved in the act of violence while intoxicated. The person involved would be release by the hospital in due time so the police officer can just wait for the person and bring him to the police station for further investigation. Why bother to go to the emergency room for? What for? HE IS THE POLICE OFFICER NOT THE DOCTOR ON DUTY ISN'T IT? |
