Scenario:
Straight stretch of a road with a dotted yellow line (legal passing zone)
Cop car on shoulder of one side of the road, a car is pulled over on the OTHER side of the road.
Officer on right-hand side (grassy side) of car that is pulled over. Slow-moving vehicle headed in same direction as previous car that was pulled over.
One vehicle passes that slow driver then another person (our driver in question here) passes the same vehicle and as they are completing their pass, the cop walks into the street and motions for the person to pull over (and also stops the slow-moving vehicle).
Officer asks for license/registration, walks back to the slower driver, comes back to our person.
**Keep in mind that additional vehicles are still going down the road**
Officer goes to car and presumably runs license/registration. Officer returns to our person and claims they were traveling 9mph over the posted limit (and that the slow-moving vehicle was going 8mph over the limit)
Officer issues citation for our person, lets slow driver go with no repercussions.
1) Could the 9mph over have been from the first car that was pulled over? Meaning, is the radar gun *locked* onto that speed until the first incident is completed and the officer returns to his car and resets the gun?
2) How could our driver pass someone going only 1mph faster and complete that pass in, say, less than half a mile when it is readily apparent that our driver completed the pass in probably less than a tenth of a mile.
3) If the radar gun was NOT *locked* onto the speed of the first car pulled over, how can the officer state that our driver was going 9mph over the limit when several other cars had passed by before he went to his vehicle (also keep in mind this is a stretch of road that is usually quite deserted and people routinely travel 15-25mph over the posted limit so any of those cars coming down the road after our driver was pulled over could have been clocked at a higher speed and slowed down when they saw the flashing lights)
Would you say our driver has a very good case for having this dismissed in court, esp. considering there are zero previous moving violations on record?
