Do warrants expire????????
Find answers to your legal question.

Do warrants expire????????

My brother has been wanted for the last several years for kidnapping, contempt of court, and I think burglary. But some how everyone in my family has convinced him that if he avoids the police for 7 years there is some statute of limitations that will make his warrants expire. I told him just to turn him self in and take care of it because warrants don't expire but he doesn't believe me. Is my family actually correct or am I right? We live in Colorado in case that makes a difference.

IDK

But it makes me think of the end of the movie THX1138.

lol No, they only "expire" if the issuing authority cancels them for some reason. Other then that, especially for charges like that, they stay in the system and I'm surprised nobody has come looking for him yet.

Kidnapping, attempted kidnapping, and conspiracy or solicitation to commit kidnapping each have a 10 year statute of limitations.

If the victim was transported across state lines, it falls into federal jurisdiction, where there is no statute of limitations as far as I know.

If the perpetrator was out of the state, the statute of limitations is on "pause" for up to five years, which means that the warrant could be in effect for up to 15 years if they spent at least 5 years out of the state.

In the state of Texas they never expire, but in California depending on the warrant and such some warrants have a statute of limitations on them, just not in the state of Texas and possibly other states I am not educated to about this.

You are gonna want to check out the revised Colorado law statutes. Last I heard fairly recently in fact, there are now no statues of limitations here in colorado on felony charges.

for each crime the warrant has a different limit. Also depends on the state, kidnapping is probably going to be a heafty one. Burglary can also depend on the kind of burgulary. Armed, or not. Look it up at your local PD its public knowldge

it depends on where the incident happened or where his warrant is.
most wont expire and by the look of the charges he has against him the longer he "avoids" the warrant the harder it could be for him, because as time passes they might also throw on there evading and some other useless terms, and the officer that pulls him over for a tail light could end up a hero.....for a lack of better words. i have heard the 7 yr rule for a lot of things like taxes and bad credit but never for warrants, because even if he leaves the state or country there is always a chance to be sent back to the state (colorado) in which he is wanted.

cops don't stop looking for people, because if they did the prisons wouldn't be as full.

good luck but i think the best thing for him o do is to not avoid it but take responsibility for his actions, man up so to speak.

Never.... I just found I had a warrant this is ovewr ten years old never knew about it never received a letter for court or anything

The longer he waits the more severe the penalty will be. Cold cases are revisited, like if he hasn't paid any income taxes, he could be caught for tax evasion, then the old cases can surface.

yeah it does expire but there are odd limitations on that. If someone is out of state or is a fugitive then the time stops and it doesn't count. So him trying to hide isn't going to expire the warrant.
