Do you have to answer the cop when you're in the police car?

say someone gets caught shoplifting. they admit to the crime. the police officer proceeds to arrest them. while they are handcuffed in the backseat of the car, can the police use what he asks them against them in court?
note that the officer has not stated their miranda miranda rights.

If the person admitted to the crime before they were placed under arrest the confession is admissable in court. A person does not to have his or her Miranda Warning read to them until after they are placed under arrest and asked specific questions regarding the crime they are arrested for.

No, actually you never have to answer the cop. Even in court you can keep your mouth shut. However, if you do admit to it after being read your rights, than that can be used against you.

they have the right to use it against you even though your rights haven't been read.

You never have to speak to a cop. But also remember many are never aware or read there rights until they are in the police station. And by that time it is too late. You just squealed like a pig.
