A person who is arrested based on suspicion of a crime should be told, at the time of arrest, what crime he's suspected of, and that he has the right not to testify against himself.
The other guy, apparently a real cop, said it isn't necessary to read him his rights until he is questioned. That sounds reasonable, but anything he says can be used as evidence against him, including any comments at the time of arrest, or 'conversations' in the police car or the police station that he might not perceive to be interrogation. So he should be warned, basically before he has a chance to say -anything-, that anything he says could be used against him, not just formal interrogation in the little room.
A lot of arrests are not in connection with suspicion of a crime. For instance, a guy who's drunk in public, the police will pick him up and let him sleep it off in the 'tank', then let him go. He's not going to be charged with a crime, so he doesn't need Miranda rights. I was arrested in the 60s in connection with an anti-war protest, and they basically just bussed us all down to the police station and got our names and addresses. We were never accused or charged with a crime, it was just part of a police intervention to break up the crowd. So I was never informed of my rights. |

It would depend on whether or not I want to question the suspect about what they did. A lot of other people question the suspects before they arrest them so that they don't have to read the Miranda Warning. It can be useful if you know how to use it.

I don't think ANYONE should EVER be Mirandized. You should KNOW your rights. Failure to REMIND you is NOT denying you your rights. Actually preventing you from exercising your rights is denying them. |
