Does a 17-yr. old male have a right to physically assault a 23-yr. old female for no reason?
Find answers to your legal question.

Does a 17-yr. old male have a right to physically assault a 23-yr. old female for no reason?

The police threatened to take me to jail & not him, & they wouldn't allow me to press charges.

Get the police report and see WHY they made that descision. If the report is unacceptable to you, you can talk to the cops boss and the boss has the authority to make him rewrite the report and if the report is rewritten it may give you the option of pressing charges.

There's more going on here than is being told, if you don't mind the comment

no one has the right to assault anyone. I would keep trying especially if you believe he is going to try it again for your safety. The more the officers see that you are in fear for your safety the more likely they are to handle your call a little more seriously.

In most jurisdictions, battery (what it sounds like happened to you) is both a crime, which is criminally actionable, and a tort, which is civilly actionable. If the police say they aren't going to press criminal charges, there isn't a lot you can do about that. Only the state, through its various law enforcement agencies, can do that.

That in no way stops you from hiring a lawyer and filing civil charges, but be prepared to spend a few thousand dollars. Lawyers don't work cheap, and if the person who assaulted you doesn't have much money, it isn't likely to be worth it.

nobody has the "right" to assault anybody. he is still a minor so that changes things...it would be different if he was an adult.

lady beth
i doubt that there was no reason. it may have been a stupid reason, but a reason all the same. i dont understand why they would not let you press charges. maybe because he didnt assault you. good luck with that.

please make sure to get that girl as far away from him as possible. a woman should NEVER have to live with someone that lays a hand on her. it is UNACCEPTABLE!

Since i don't have all the facts I can't make a judgement but if he came up to you and attacked you with out provocation he should of been arrested. Get a lawyer and see what she/he has to say.

mikeysco
There's obviously more to this than just the question you're asking.

Nobody of any age has the "right" to assault anyone of any age for "no reason."

Beyond that, it's not possible to give you any relevant information without knowing more about the situation.

Wolfpacker
What did you do? You can go down & press charges but beware of false charges as you can be sued.

Steven B
Technically you can press charges on anyone 13 years or older, I believe. If this is a serious issue, you might want to check with an attorney and see what your rights are and what you can do about this.

Anne M
I agree there is more to it that is not being told. The way you put the question makes it sound as if your totally innocent. That could happen but isn't likely.

ro gulley rat
get advice from a lawyer if you did not do anything wrong and a copy of the police report. in some states a 17 year old is consider an adult. they do go to prison for capital murder. i would just talk to a lawyer.

DUMPLINGS
no because females and males are the same with well..... the ... well we all get it and females can be 50% better than males and males can be 50% better than females and i say we should change that

Frank
This depends on the situation. The cause of the incident will determine the action by the police. If you were guilty of beginning the problem, then you were the aggressor, moreover if the male felt intimidated by you, then it would be acting in self defense. You haven't explained sufficiently to give a better opinion.

Students can be charged with assaulting their teachers (who are adults).

You need to make a better case for yourself. Pursue it with the authorities and send a certified letter/statement of sorts to explain your views. *****If you can afford legal representation - do that 1st.

Don't put anything incriminating in your statement though - lol.

no no, are u sure there was nuthin from ur part?(coz 17 yr old is a minor)
If u r perfectly innocent, there is no reason they wud take u to jail.
Which country are u in? In most countries, only after u press charges, police will invesigate. Approach a different Police HQ.
