Does a criminal have to be imprisoned in the state where he committed the crime?

If the person committed the crime while being on vacation in another state, does he have to serve the time in the prison of that state or can he ask to be moved to the prison of "his" state?

Does it matter that he spent all his life in "his" state where he paid taxes? I am asking because he belongs to his state and not to that state where he committed the crime.

The sentence will be served in a prison chosen by the State where the crime was prosecuted. That does not mean the prison will be in that State. Some States have contracts with private prisons which may be in another State. We have several private prisons in Oklahoma. There are prisoners from many States. Doubtful that you would get any choice in the matter.

Probably not. Vermont exports most of it's prison population to other states. Why would his home state want to pay $40,000 to keep him around for a crime he commited in another state.

You are charged and serve time in the state you committed the crime. The exception to this rule is a federal offense. If you are charged on a Federal offense, you can be sent to any federal prison in the country to serve the sentence.
