No. Any medical treatment you received is confidential under HIPPA laws. They will not get any results for the emergency room. |

The hospital can't give your results to your Probation Officer without either your permission or a warrant for it....but here is the kicker. I am pretty sure that as a condition of your parole, you had to sign a piece of paper granting such permission whenever the P.O. wants your test results. I am also pretty sure that if you refuse to hand the results over that you will find your parole is revoked and your butt will be back in jail and/or prison.
If you don't believe me, that's fine...but you go talk to a lawyer and he will tell you the same thing...I did it though for free! |

I don't know. In N.Y. you cannot get any information under the new HICFA rules, but I don't know if that applies to P.O's. Then again, I'm sure they use the same intimidation tactics that the police do, so yes, they'll probably get your BAC results very quickly. If that doesn't work, it'll take 2 minutes for a judge to sign a warrant here in Suffolk Co. NY and get the results. If you are doing what your supposed to be doing then you might not have anything to worry about, right? |
