hi, a friend of mine was stopped for driving with no seat-belt. When his fine came in the post, it was stated that he was driving on a different road than he actually was driving on. Can he contest this fine, or does this make any difference. Thanks for your help.

He can contest it if he wants but he'll have to do it in Court. |

Your friend could try to contest this fine, but the fact that he was not wearing his seat-belt will still stand. The fact that the wrong road was cited will be put down to an "administrative error". He was still not wearing his seat belt and will be fined accordingly. |

I SEe you problem, the issue is the ticket was issued with the intention to serve a fine for an offence committed, there are technicalities that may get you off, as the ticket has the incorrect information on it, but you have to be sure that he/she didnt see you on the road mentioned. If you did travel along that road you are liable. If you have never travelled along that road then i understand and this should be pointed out as the ticket was incorrectly issued, independant advise is the best route.
basically if the officer can prove that they saw you driving on a public road not wearing the seatbelt correctly (over the shoulder) and its was down to a minor clerical error the magistrate would still deam the ticket valid. so i would pay the £30 and call it a day, if you let it got to court you may get more and poss points for nothing really.

He can plead not guilty and opt for a trial.
The issue of the road will obviously come up at trial and the correct road will be accepted. Your friend will most probably be found guilty and have to pay more than the inital ticket.
It would be cheaper to just pay it and accept that he should be wearing it. |

If he accepted a Fixed Penalty Notice he is obliged to pay. If he was cautioned and charged and reported to the CPS or PF he can plead not guilty as the facts are wrong. |

He's lucky he got off that light. Usually the people not wearing seatbelts are also the ones who speed, use a mobile while driving, don't have tax or insurance, hog the middle of the road, have faulty lights, have accidents and cause the rest of us to pay higher insurance premiums. |

He will have to contest it in court, however the judge will take the main argument into consideration, "does it matter which road the officer wrote on the ticket as the offence occured regardless"
He may find the judge will still rule regardless on which road the officer put down on the ticket that the offence still occured, the judge then may increase the fine or tell the person to pay court costs as well.
Its a risk you friend will have to take a gamble on, pay the intial fine, go to court and get off scot free, go to court and end up paying more. |

Oh that old chestnut "I have a friend", Come on own up it was you wasn't it? Any traffic law is there for a reason as was the traffic cop that stopped two bikers tanking past me on the way to Cadwell today. The fact is seal belts do save lives as do correctly fitted child seats. I cannot understand people who don't wear belts or who do not put their children in the proper car restraints. Come on play the game and just pay up or get your mate to. |

take the letter to a solicitor, we pay enough as it is!!!!! the money never gets spent on road improvement as it should anyway. If they cant do their job properly,the fine's not worth the value of the paper its written on!!! |
