Driving under the influence, but what could..?

so a friend of mine got into a horrible car accident yesterday morning, he was drunk driving on the freeway and had another female friend in the car. the car flipped over, totaled, and everything. he's 20. This happened in CA. they arrested him because of suspicion of a drunk driving, my questions are:
1) how long would he hve to be in jail from the day this incident happened?
2) what could happen to him?
3) what could happen to the girl that accompanied him?

It's SUSPICION.....not proven yet.
He won't know what's going to to happen till he goes to court....period.
If the cop DIDNT see him wreck, and he WASNT in the car or immediately near it when the cop arrived, they CANNOT arrest him for DUI or any crime similar.
They legally CANNOT prove he was driving it while intoxicated, EVEN if he's drunk and standing around when the cops arrive.
Unless he admitted to it, or said something to POSSIBLY incriminate himself.
You can even see a few episodes like this on Cops every once in a while.
Somebody is drunk, wrecks the car, walks away from the scene.
The cops show up, the guy stumbles back to the scene.
The cops cant do ANYTHING, except nail him for public intoxication if he is dangerously drunk near a highway.

well he has a slew of charges against him, he's lucky he didn't hurt the girl or he's be in even more trouble. Underage drinking and driving and crashing.
He's gonna need a lawyer for sure. This is going to cost a fortune. Say by by to his license for quite a while and jail is a strong possibility. |
