The judge in all likelihood has issued a bench warrant for his arrest after he failed to appear. I would be prepared to provide bail money for your friend when he shows up to court. With his recent failure to appear and his prior DUI I don't believe many judges will be too lenient on him. |

I don't think you would 'forget' to go to court. I think it more likely that he 'chose not to go' to court. If I could give you any advice, it would be to advise your friend to go to his local police station and hand himself in. It will only be a matter of time before the police arrest him and keep him in custody to appear before the court. As regards sentencing. He could well face a prison sentence, but the prisons are overcrowded so it may well be he'll get a huge fine and a few years ban. Courts don't take likely to people who flaunt the law (2nd time drink driving). Your friend was lucky he didn't kill someone. There is no excuse for drink driving. Basically he deserves what he gets. I have seen too many people maimed or killed through selfish people who drink and drive. |

If he has a warrant out for him yes most likely he will go to jail!! Being that this is his 2nd offense for this I'd say he will be in deep doo doo, and I wouldn't count on seeing him for a while!! |

I think its ridiculous someone can 'forget' to go to court for such a serious offence.
If he hands himself in now he will be taken to court via group 4 security and he will be placed in a cell at the courthouse
He will then have to wait untill they will see him and ontop of a 2nd drink driving offence he will be charged with skipping bail
He will be lucky if he escapes jail, the only thing on his side at the minute is how over-crowded our prisons are! |

Hope he goes down, to many people get killed by drunk drivers if that was one of my friends i would disown them, however the law will probably give him a short sentance and a large ban, would reccomend not forgetting to go to court but will probably just increase the fine. |

Could be a prison sentence or a REALLY big fine and a LONG, LONG ban - but prepare him for the worst - could well be a prison term.

My my seems he thinks the three strikes is a joke.....he will never be able to drive again in his life time......well not like an insurance company will want to insure him...he is a liability.....3 times over the legal limit?...and he forgot to go....my 6 year old can give me a better excuse than that....... |

He deserves to go to prison and get a lifetime ban, not that it will happen. The judges are just to soft these days. |

depends on the state you live in (laws vary from state to state) but if he didn't show up for his court date, the judge isn't going to be happy. There's a good chance he's facing at least a bit of jail. If he doesn't show up for court, then he'll get thrown in jail as soon as they catch up with him...and believe me it will catch up with him. I've seen people get popped on a failure to appear warrant 5 or 10 years down the road when they don't even remember what they were supposed to be in court for. Tell him to show up for court and face the music now. |

£200-£500 fine and banned from driving until test passed at the least. 3 months in pokey at the most + banned until test passed. It all depends on the magistrates. Aggrevating circ's being that he hit 3 other cars. |

If there's a warrant out for him, as soon as the Police see him, he will be arrested and the fact that he has such a blatant disregard for the court's authority that he didn't even bother turning up will undoubtedly mean that they will not look favourably on him and he is likely to end up with a sentence.
It's interesting that you use the words 'this is the second time he has been CAUGHT drink driving'. It may well be the second time he's been caught but more than likely not the second time he has driven over the limit. His behaviour is totally irresponsible. What they should do with him as well as ban and jail him, take him to the local morgue and show him some victims of drink drivers and then put him in a room with their relatives.
He sounds like the last sort of person you need as a friend. |

He will probably get another date and be remanded in custody since it will be seen that he avoided the last court date and cant be trusted. This is not going to look good for him |

was he on bail, because as much as it sounds a bad crime to skip it, he'd prob only get a £50 fine for that then his originally offence will be dealt with |

i think it was more likely your friend choose not to go in the hope of keeping his licence longer. it's likely the ban will be 3 years and a hefty fine given that its ten years since the first offence |

Right, lets put the moral stuff behind us.
You could have better friends, he obviously didnt take it seriously enough blah blah blah everyone makes mistakes...
but he's going to get what he deserves this time round at court.
His second time drink driving, crashed into vehicles. So he's shown not only that he has no regard for the law in committing the same offence, but he has shown criminal negligence and probably failing to report an RTC.
Then he committed a whole new offence of Failing to Appear, which is very serious, and courts have issued a warrant.
He will definately get some kind of custodial sentance.
Its likely to be a week or so, as well as a fine for damage to the vehicles and court costs as well as a community service order |

He will be arrested and charged with fail to surrender... if he hands himself in it will be better for him. He may get a nights detention for the FTS and will probably be fined banned and ordered to pay compensation to the other car owners who's cars he hit.
The likely hood of custody is slim unless he left the scene and tried to wriggle out of the offence.
Best bet is to plead guilty take the punishment and this time learn from the experience, if he wants a drink don't take the car and count himself lucky that the cars were parked and not occupied.
Tell him to give himself in to the nearest police station before the warrant is executed! |

could be from 1-5 years in prison and/or up to a $5000.00 fine. He may also lose his licence for up to 1 year. Not to mention restitution for the damage he caused. Not that that would matter to someone who so callously puts others lives in danger. However, he may get a judge that was caught doing the same thing the weekend before and just get a slap on the wrist. But still, in my opinion, he should get the max because he didn't show up and that shows a blatant disregard for his offence(s). He could have killed (maybe a child) someone, would he forget that? Maybe you should find more responsible friends. Just my opinion. |

I have trouble believing the ignorance, arrogance and unsympathetic answers here.
People are people, they make mistakes, sometimes very very silly mistakes but they are still mistakes. And we are all different. We respond in different ways to stress.
Your friend is in deep trouble and should IMMEDIATELY find a good DUI Lawyer. He will need to contact the Police, but he must be very careful how and when he does it because what he says WILL be used in court.
The conviction from 10 years ago might not be counted against him but he needs professional help.
