Enhanced CRB check - arrest and £80 fine for theft?
Find answers to your legal question.

Enhanced CRB check - arrest and £80 fine for theft?

Last September my university requested an Enhanced CRB check which came back clear. However, last December I was arrested and taken to the police station for shoplifting. I was given the choice of an £80 fine or a caution.

I explained to them that I am a student radiographer and working at a hospital on placement. They suggested it would be better for me to pay the fine. This was paid on time.

I am concerned because it is my only offence and this September my university will need to carry out another Enhanced CRB check. Will the fact I had to pay a fine for theft show? Or that I was arrested for theft? Or both?

Do I need to declare this when filling out the form for the check? Also, do I need to tell the Professional Issues Team at the university before September?

As I understand the check will be mainly to see whether I am suitable to work with children and vulnerable adults, that I have no drug abuse history, violence etc as these factors will be important to my future career.

No, by agreeing to have a penalty notice for disorder (PND) and paying the fine you will not receive a criminal conviction. Accepting and paying the fine is not an admission of guilt but discharges the possibility of the creation of a criminal record.

The fact that you have been given a PND will be recorded on the Police National Computer but it will not create a criminal record. The information is recorded for administrative purposes and also to establish if a person has had more than one PND.

If a criminal records check is carried out it does not automatically mean that the PND would be disclosed. However it could be referred to if the behaviour that lead to the PND was linked with the reason for the check.

I do not think that fines show up, if so most of us would have a list of motoring fines etc. I do know that cautions do, so I think you have received the right advice.
As a law abiding person, I still have commonsense, and if it was me I would not say anything about it to anyone. You have learnt your lesson.

Some Random Dude
it will say that you were charged with theft

you will need to declare it, if you don't you get into more trouble

it should not stop you from
