police just pulled me over and said my music was to loud and he ticketed me and tow the car and left me on the expressway

Music too loud.
Many states have a decibel law, as to how loud music can be, before it drowns out sirens, emergency alarms etc..
So under the Discretionary Decisions Doctrine, made by a Law Enforcement officer, he must have had a rearsonable rational to ticket you? |

Did you get a ticket for having special radio equipment installed in the car or for having loud music? I believe you said you got it for having music too loud. I don't think the officer cared why it was too loud or how it got too loud but that it was simply too loud--and that's what YOU claim you got the ticket for. Therefore, you were not "falsely" ticketed. Further, they would NOT tow the car nor would they stand you on an expressway simply because your music is too loud. So, either there is something else going on here and THAT'S why they towed towed the car, but that still leaves that fact that they would have arrested you. I go for that's a lie in which case, I don't believe any of this ever happened.
Somebody should ticket you for your spelling and inability to use the spell check. |

It doesn't matter if you have Equipment, if they thought it was loud, they thought you may be a distraction to other motorists and the music may have been dangerous on the road. They shouldn't have towed your car away though, that's a little of the edge. The only thing you can do is try to fight the ticket. I don't know where you live but get the court date and I do recommend to reschedule it out the maximum times you can which in California you can reschedule, by the third time rescheduleing at the last possible moment ther's a very good chance the Cop wont show up to defend the ticket and you can win. If he does show up then the judge always trusts the Cop, and you will have to pay the ticket, but it's worth a try. Good Luck. |
