every case is different, but there are any number of defenses available. Furthermore, the charge is often dependent on technology such as the breath machine. It may be that the prosecutor has a slam-dunk case but you should get a lawyer to at least look into the calibration of the machine, and the procedures employed by cops and technicians, such as the reason for pulling your over and the technique for the chemical test. You have the absolute right to plead not guilty and require the prosecutor to prove the charges even if you are indeed absolutely guilty.

you can fight it with a lawyer specializing in DUI defense. they may be able to get it lessened but, you will end up paying the same amount of CASH! plus, if they fail you're screwed. best way to fight a DWI / DUI is not to get one... sorry mr. rednecktrash.

If you were drunk what kind of evidence can you show that you weren't? Most states have very specific sentencing guidelines for DUI's. Generally you will get the minimum sentence the first time.

They have really tightened up the laws on DWI , even with a lawyer you will probably have a suspended license even with a first offense. However if you need a work permit to get back and forth to work and to walk you through the system a lawyer might be helpful even if he can't get you off Scott free

Get a lawyer. You can usually plea bargain your first time pretty well. Depending on your record, hopefully a clean one. Obviously they usually frown upon someone that has multiple violations as they just dont get it.

No, you are talking big money here that goes from your pocket into the legal system and win is not an option on your part. Cry poor mouth every step of the way and they might reduce it to careless driving but if you got money, they are going to take it.

You can try to fight it. I know people who have gotten out of it, but I also know of people that invested alot of money in a lawyer only to lose. GOOD LUCK!!

Do you mean if you were the drunk driver?? There are a 1,000 lawyers in your local yellow pages that you can call and ask questions for free. You can even get a free 1st visit with them. It is kind of hard to argue a positive Breathalyzer or blood test. I mean...you were either drunk or you weren't. Nine times out of ten you will have to hire a lawyer anyway to get you through your court day and paperwork. They also may be able to bargain your punishment but either way it is inevitable. :( Sorry.

Oh, and if you meant to sue a drunk driver...lol...ur insurance may be able to sue their insurance for damages, however, if Joe blow drunk guy hit you...I mean, really, what could you expect to get from them? Probably nothing. As a matter of fact I always say "I pity the fool that tries to sue me." because I have nothing. lol

Usually the best you can do is get a lawyer to talk it down to Recless Operation. Not a whole lot better, but next DUI would be the 1st instead of a second offense.

If you are guilty, it won't help you. If you are not guilty, get a lawyer to fight it. If you are guility, get a lawyer to plead down to a lesser penalty.

I wouldnt even attempt it....if you were guilty then you were guilty...and a lot of times they will have it all on tape....most of the time it is more of a headache to fight it than it is worth. Best of luck, and remember: don't drink and drive.

the sooner people understand that every dwi defense attorney says that "YOU" have a good case, YOU don't. this is how they make their money. do you think for one minute that they are going to tell you "OH, don't hire me?" of course not. i am a transportation consultant, and i have seen commercial drivers as well as Friends alike try to fight these things. it usually doesn't work. a person drinks for one reason, to impaired their personality, the first drink changes your judgment from before you started. One for the road is too many. I have been to too many accidents where someone has died from a drunk driver, and most of the time it is not the drunk. could you live with yourself if you killed someone? ask yourself that every time before you take that first drink knowing that you have to drive. so the answer is, take your punishment. own up....this us usually the first time that someone gets tangled up with the law and think they are going to be the one "THAT CAN BEAT IT. i have never herd anyone in this situation say "I did it", everyone wants to believe it "was an illegal search.

Well it depends on what your BAC was? If you weren't drunk or barley over legal limit, YES fight it....if you have the money. Is this your first??? The worst thing the judge can do to you is fine you up the butt and make you take classes, but both of them cost time and money. So you see whether you fight or not it will cost you time and money. So it is a personal decision to fight or not to fight. Good luck!!!
