THe law requires n accused person to make a plea in relatio to the charges they are facing. Obviously this means guilty or innocent.
Does this affect the legal process? --from time a person is charged, to sentencing or appeal.. Is it different for summary and indictable offences? If you plead guilty, the matter goes striaght to sentencin yeah? But if you plead guilty, is there only like a judge in front of you to listen to your case? Any explanations? (from people who know their legal stuff)

Typically the plea happens early on. If there is a grand jury indictment, that happens first. That is like if a warrant is issued, it happens before you plead not guilty or guilty. If you do plead guilty, you will still get a sentencing date, depending on your charge (it is possible it could be right then, unless it's a felony charge). And it would just be the judge, no jury there if you plead guilty, unless you initially pled not guilty and the case started. Also, if you were to plead "no contest" it is essentially the same as a guilty plea. You would always have a conviction on your record just as if you pled guilty, unlike what another poster said. |

Look into a plea of "No Contest" an option that as I understand, is not a guilty do inocent plea but one that limit actions that can be taken aginst you, |

At arraignment you are asked to plead guilty, not guilty or no contest.
If you refuse to plead, a plea of not guilty will be entered for you. Regardless, any plea is a admission the law applies to you. All that is necessary once you have plead or the court pleads for you is the extent of your liability, i.e., how much is the fine or what is the penalty. If you do not believe the law applies to you, you will need to enter a challenge prior to arraignment. This can be complicated and if you don't know the proper process the judge will become irritated and give you the maximum penalty instead of maybe the minimum. |
