Going to Traffic Court today, need some advise.?

Okay, first time going to traffic court

I got a speeding ticket doing 69 in a 40

I plan to plea guilty and say the following, please tell me if this sounds good or change it.

" It was an accident, I wasn't paying attention to my speed. This was a definite wake up call to pay attention more. It will not happen again and you will not see me here (traffic court) ever again. I do apologize"

And any advice would be great

Talk to the States Attorney, and see what type of options you have if any.

If you plan to plea guilty, you do not have to make a speech, at lease not in the state of Texas. All you have to do is pay the fine, or make arrangements to pay it in installments. On a diffrent note, your note sounds very nice and sincere. Thanks for being so responsible.

INSTEAD,,, Grab the prosecutor, DA or whatever your court calls him before the trial. Tell him you will plead to a lesser speed. Chances are he will accept, they just want the money. May save a couple bucks o the fine.

It may not give you any benefits in regards to sentencing, but it won't hurt.

I agree with John A. You won't get by with that and the officer who wrote you the ticket has already given you a break by not writing you a ticket for how fast you were actually going. No one gets caught doing 69mph. You were most likely doing over 70 which would have thrown the citation into a higher catagory with a larger fine. Omit the explanation and just say "I'm sorry" and "Yes your Honor".

The judge will not let you get away with that defense. Just hope the cop will not show up that wrote you the ticket. 69 in a 40 zone is impossible to defend.

You wont be given a chance to say anything except guilty or trial. There will be too many other persons there and the judge will want to get to the nincompoops that think they are going talk their way out of the ticket in the trials.

Chalk it up to a lesson learned and sin no more

You may not get much of an opportunity to say more than guilty.

Most likley you won't get a Judge, you'll get a Magistrate "Someone who wants to be a judge" most of them are a**holes and pretty much ignore any "excuse you have." Just to show how tough they can be "If" they are to ever be a judge.

One guy had his father pass away. While his dad was alive he used his dads car to get them back and 4th to the hospital. When his father died, his sister came into town her family used his dad's car. The man in court used his own car the tags were out of date but it was inusured. With the running back and 4th to the hospital for his dad he hadn't used his own car in over 6 months. Got pulled over driving to the Funeral for having expired tags.

The magistrate Fined him the maximum, and basically pretended not to hear what I just wrote above. Sad part was the guy that was pulled over was doing his best not to cry. You could tell he was being honest.

69 in a 40 your looking at around 300$ plus court fees. The DA may plea bargin your charge down to maybe 1 point instead of 3 points if you agree to pay. Hope it wasn't in a work zone or a school zone he will double it up on you.

No matter what you say dude is going to fine you and ask for the next person in line.

What you say after pleading guilty is meaningless. If you want mercy, present a defense, and hope for the best.

Your planned speech essentially says "I am a crappy driver and I know it. I want you to give me a break because I promise to not be crappy now although you only have my word for it".

Why would a judge give you less then the full fine and points penalty with that argument? Place yourself in his or her shoes.

Honestly, and "accident" you were going 30 miles over the speed limit? Lucky you didn't kill anyone including yourself. I bet the judge will say that to you!

Just so you know that the result is going to be and are not mad later.... :)

Tell them that you know that you were speeding and that the Police Officer was professional and did his job. Tell them that you can't afford the ticket or for your insurance to go up and ask for a break.

Nobody tells the truth. They'll find it refreshing and you'll do well.
