Going to court for my DWI 3 years later.?

I got a DWI 3 years ago... I went to the first hearing right after I got it and they wanted to give me probation. I never heard from the court again. Now 3 years after I get a letter for another hearing... I went to the hearing and I asked what took so long. They said the court lost my file. They are still trying to give me the same amount of probation that was originally offered. Is there not some sort of penalty against them for losing my file and taking so long? Should my case get dismissed or at least reduced? I have to go back for another hearing in a couple of weeks

No, the delay does not matter at all.

Once the charges are filed, the clock for "statute of limitations" stops and there is no time limit anymore.

No you shouldn't be given a break. Them screwing up and losing the file has zero bearing on your criminal conduct and your sentence.

contact a lawyer..Never just plead guilty..A dwi will affect your record/insurance for years and years
